rental question

ok since tosca posted about his rental in Menlo Park/Atherton... maybe you guys and gals can help me out.

i am moving soon, and i gave my landlord 30 day advance notice. i wrote him a letter on the 15th this month, so that means i plan for the 15th of next month to be my last day. he calls me up and says that i can't give notice unless it is 30 days from the beginning of the month. i looked at the copy of the contract that i signed and it says i can terminate residence if i give 30 days of notice. it doesn't say anything about 30 days from the beginning of the month. then i get a note from the landlord stating that i have to give 30 days notice from the beginning of the month. i read up on the renter and landlord rights and i think that my view is valid, and i should be able to move on the 15th and pay only up to the 15th. he expects me to take time out of my schedule to show the place too. i want to leave happy and i don't want any bad feelings between the landlord and myself. any recommendations or legal advice? thanks.

he's hustling you. you have no obligation to fill the vacancy. 30 days notice is 30 days notice, it doesn't say "one calandar month notice" on the contract. Time for me to get out the lead pipe?

but this should be in general OT, you'd get more advice there.

I believe that is his job to show the place, not yours. You are only required to make the place available.

Most all agreements say at the beginning of the month. Are you positive yours doesn;t?

this is what the rental agreement says:

This agreement, entered into this "date" between "my landlord" and "myself" hereinafter called, respectively, Lessor and Lessee.

Witnesseth: that for and in consideration of the payments of the rent, and the performance of the covenants contained on the part of the Lessee, said Lessor does hereby demise and let unto the Lessee, and the Lessee hires from Lessor for use as a residence, those certain premises described as "blank", located at "address", for a month-to-month tenancy commencing on the "date". The monthly rental rate of $ dollars per month, will be payable in advance, on the first day of each and every month.

The Lessor hereby acknowledges the receipt of the sum of $ dollars as cleaning fee and sum of $ as a security deposit, refundable as provided by law.

rules and regulations

1. The said premises shall be occupied by no more than, and only the following named adults, "myself", .....

2. Rents are to be paid on stipulated dates.

3. A remittance of $ will be required for each key requested, and equal amount will be refunded when keys are returned.

4. Quarters are not to be sublet or assigned.

5. Guest are to pay for any damage to apartment property for which they are found responsible.

6. Checks will not be accepted in payment of final bill.

7. For a month-to-month tenancy, 30 days notice is required when terminating tenancy. If this notice is neglected, guests will be made liable for ensuring month's rent.

8.The management is not responsible for lost or stolen articles.

9. The management has the right to enter guests' quarters for any lawful purpose after giving proper notice.

10. The prevailing party shall be entitled to reimbursement for all expenses which may be incurred, including reasonable attorney fees, by reason of any breach of this agreement.

11. Guests are required to abide by all posted rules.


so krazik is this like Most all agreements say at the beginning of the month???

i think 15th->15th notice is perfectly fine.

i think it is his responsibility to show the house, but if you are on good terms with your landlord, it would be nice of you to help. i would do it for my landlord. but then he would let me give 30 days notice on the 15th.
