Someone Hit My Car!!!!!!!!!!!!!!!!!!!!!!!!
Argh...
I went to a mall after work with my gf to go exchange a pair of boots. I pulled up into a parking stall in the parkade which neither stalls on my right or my left were occupied :thumbup. I was like in my head, no chance of someone giving me a door ding.
At the moment I was facing my gf and talking to her, I had JUST finish opening the door HALF-WAY when all of a sudden, I heard a slight crunch/bang and my hand lost grip of the inside handle of the door
. I turn my head around and I see this f##?king white sunfire with a 50+ or so woman in it in a bit of shock
I got out of my car miffed
as the sunfire finished parking and the woman came out. I wasn't sure who was at fault and neither did she
. So I proceeded to call my insurance company and I told the agent what happened. He said it was my fault
I was like wtf. I think the agent may have misunderstood me though: perhaps he thought I said I opened the door and I hit a PARKED car with the door
No visible damage on my door as far as I know: the driver hit the edge of my door (the edge closest to the rear). There is a bit of white paint though on the edge of the door and a bit inside. The right corner of the front bumper has some of my red paint from my car and some scuffs. Woman and I exchanged #'s and insurance company names. She did mumbled that she doesn't own the car and that the owner is not back in town yet I was like whatever in my head and asked her to call me when she talks to the owner.
So, what's the verdict here?
Oh yeah, it's my civic that got hit. God damn...only been 2-3 days of ownership and it's already starting to be a beaten-up beater...

If you opened the door and "surprised" her and she had no opportunity to register the obstruction and react to it, I think it may be your fault - sorry.
It is the responsibility of the person opening a car door to ensure it is safe to do so. This would be not much different than if you were pulled over on the shoulder of a highway and suddenly opened your door and a passing car took you door off.
Now, if you had the door open before she even entered her parking stall, this would be a different story. Then, it is her responsibility to stop and give you the chance to either get out of your car and/or close your door to let her get in.

At lease you were at the scene and got #s if is your fault or not. The rents Accord got bumped again on the front bumper this time, taking a bit more paint off. This is the second time, and the F#$%^% took off without leaving any note.
My Sebring touch up paint has more use on the Accord than the S thank god.
