Get a different opinion on the damage and if there is frame damage. Check out the local forum and find the best body shop in the area. Have it towed there, even at your own expense to make sure about the frame, they will probably fight you on this to cover there ass. Straightening out a frame makes it weaker than factory because it was already bent once. I seriuosly doubt you will get any other car unless there is frame damage. If not, just have it fixed, that is about all you are going to get. It sucks, but unfortunitly that is the way it works. But make sure you get it fixed at your choice of body shops. Good luck!!!

new car and if you owe on that one they should pay for it. If they dont tell them they have 24hours to make you 110% happy or your lawyer will be the next phone call they recieve.

i think i'll just reiterate what others have said, based on my own experiences:

1. make sure you have a police report.
2. contact your insurance (they should be very helpful, if not, get a new insurance company )
3. ask for a rental on their dime
4. have the car checked out at a body shop of your choice on their dime

Do all of this professionally and politely. if you have problems with 1,2,3,or4, while being polite etc, .... lawyer up. at that point its not worth your time and trouble.

the people demanding a new car ...? uh thats not happening. i mean i could be wrong but... ya. not likely.

Nick....Body Shop of Barrington; talk to Paul. He's worked on MANY s2000's as well as high end MB's, BMWs, and Ferraris.

I'm sure once the dealership gets his estimate for repair, they'll happily replace your car.

Also...TAKE CAR FROM THE DEALERSHIP ASAP!!!

Don't even let them give you any crap about your tires, etc, etc. I mean it's pretty clear what's wrong here:

1. You gave them your car to fix.
2. They wrecked it.
and now
3. They need to fix the problem by either paying for the damages, or giving you another car.

Also, don't worry about that @sshole manager that wouldn't let you speak your mind. The only reason he was like that is because he knows they're completely at fault, but you know how THAT goes...he's still gonna try to save face.

I doubt you will get a new car or even a same condition/not crashed one. Whatever the tech hit tough was hit pretty hard to do that much damage!

ontario laws say there has to be 3 structural damages on the car to be considered "unsafe". ie... unibody rails, a-pillar etc... If your car is deemed "unsafe", you may have a chance at getting a replacement.

and i'm not sure why people here keep talking about frame being bent. the s2k has a unibody construction, not a frame. Good body shops have tighter tolerances that oem factory for unibody specs. Just make sure you take it to a good shop with the newest technology and don't worry about it. It will be better than new. If you or the good shop thinks the unibody may be weaker, then get them to add some more welds to it. simple.

that might be true but the fact the he took the car to them in perfect structural condition and they gave it back to him like this, its unacceptable.

get a lawyer
get an estimate from another shop
notify the BBB.

"Frame" is a pretty all-inclusive word. "Frame" just means structure in a very general sense. The "skeleton" of the car is the frame/unibody/whatever you want to call it.

And yes, this car has serious damage to a portion of the frame/unibody/whatever you want to call it. The main rail on the drivers side (beneath the car) is seriously bent out of place - looks to be pushed in a good four inches PLUS he has front wheel damage that might indicate extended damage to the front subframe or just potentially suspension damage. Either way, lots of money!

In the USA, the car can be deemed a total loss by the insurance company for any reason, pretty much, once it gets past a certain percentage of the value of the car.

The OP certainly has the opportunity to refuse the car, regardless, and a lawyer will definitely make it stick. He will, without a doubt, at least get his full purchase price back.

I'd hire a lawyer immediately if I were in your shoes. Much rather pay lawyer fees and then kick them in the nuts hard instead of cheaping it out and then have THEM kick you in the nuts to add insult to injury

Man sorry to hear about your car bro... I hope it all gets taken care of for you. I'd definitely take the advice everyone has said so far, starting with talking to them in person about this, reporting that manager to Honda, and getting a lawyer if necessary. Good luck and keep us up to speed.
