As far as this sort of situation goes, it is really hard to do, but just slam on the brakes, and don't steer. The only reason to swerve is if you already know that there is no one on either side of you, no pedestrians, and nothing to hit. As it was said above, if you don't hit him, it is hard to prove that it was his fault unless there is video, someone saw it, or he is a nice guy.

Plus, it's safer for you. Cars were designed to crash into other cars, not trees...
luckily my friends were in the car right behind me when all this happened so i have witnesses... lol well my plan was to make a left where he made a left since no oncoming cars were coming besides the car that i was about to hit. i should of just downshifted into 2nd and hit vtec so i can time travel =) haha

sounds like you're good to go. As long as you're the registered owner then Progressive usually has a quick turn around time for total losses. You'll probably have a check in hand by end of this week or early next week.
