Also, seems to me that CarMax is liable for this. I"m sure you can pin them for selling a car with an illegal exhaust. If there is a law to prevent the installation of, and another to prevent the driving of, then there probably a law that you can't sell one. Or, at least a general law that says what you sell has to be legal. You should get CarMax to take care of this.
