That bar would be fine as long as you pass the broomstick rule with your
helmet on. This rule says that your helmet must be below an imaginary
line draw from the top of the A-pillar and the top of the roll bar.

Is there a manufacturer that makes a rollbar that can be deemed "safe" for BOTH track & street driving? Something that all of you would feel comfortable driving to work everyday (without wearing a helmet
) and also taking the S2K to the track on the weekends with. Anyone?

Many people would argue that it is not safe to run a roll bar on the street.
As for me, I'm of the opinion that a roll bar is okay as long as you have a harness to prevent you from hitting the bar with your head in a crash. And if you have a harness you better also have a fixed back racing seat made with the harness in mind.
