Let us know what state youre in. This will make things much more clear. Contributory negligence versus comparative negligence can some times factor into the loss. Although, this one sounds cut and dried as you say you were not moving.

I still don't get it. Doesn't your insurance co cover the total cost of replacement? How your insurance company chooses to get it's money back from him or his insurance should be of no concern to you. I would not be trying to deal with the other guys insurance co. That's the job for your insurance co. and thats what you paid for.

Insurance companies consider a ar totalled based on the cost of the repairs compared to the value of the car.

I think it's considered totalled if the repair cost is 50% of the blue book.

Remind the other guy's insurance company that you have mdeical issues (took ambulance to hospital from the accident site) and they will try to settle quickly.

Do not sign anything from the other insurance company!
