Why would meeting "maximum occupancy" vehicle let you go through the carpool lane if the minimum is 3 people? Isn't the carpool lane designed to reduce emissions, gas usage, and traffic congestion? This makes sense for bikes since they get great mpg and don't take up that much space. You chose to buy a 2 seat car, which means to me that you chose to give up the right drive in a 3 person minimum lane.

Not sure where you are at. But in California the law is that in places where they require three people for you to qualify for carpool, if your car only seats two people (i.e. roadster, pick-up w/bucket seats, etc) then you can use the carpool lane. They cannot require you to put more people in your car than your car has seatbelts for.
In Vancouver, on some bigger streets they turn some right side parking lanes into HOV lanes. Sometimes police are out checking for violators. The sign has three people on it, but usually they let sedans with at least two people in it go. I do recall seeing the police cite a Miata though.
