Class Action for Defective Rear Window Is a Reality

Man, I know I am going to take a lot of heat for this...but, so what--I didn't buy an s2000 knowing that the damn rear window was going be demolished from the inside...or that it was ridiculously cheap plastic.

So, contrary to the claims made in a previous related thread, I think this is certainly a class action situation. MOREOVER, a local attorney agrees and has accepted my case. He is presently drafting the civil complaint.

Personally, I don't really care about your individual predilections toward lawsuits. Think suing is silly? Great. You are entitled to your opinion.

If, on the other hand, you don't want to be looked at askance by miata owners because of your chincy, defective rear window, drop me an email (cummingsbc@yahoo.com) and I will help you get signed up.

The case is being filed in the Tenth Circuit, however, you are a member of the class no matter where you live. In addition, supposing the case sees some positive results, every (EVERY) s2000 owner will be entitled to settlement proceeds. Please pass this information along to other s2000 owners. Again, as above, if you do not want a better window because you think a) you chose what you got, b) the whole country is overly litigious or c) any other reason, please go easy on my email (and confine any comments you must relay to this board).

I hope that this post is not out of line for this board. However, I really want a decent window, not just another prone to fail one, and my attorney and I believe this is an actionable defect. In addition, I would really want someone to share this information with me were the roles reversed.

It will be interesting to see how you make out Brandon. Convertible cars have been made w/these types of windows for quite some time....have you checked to see if there are any other suits filed similar to this? Good luck!

I have won 2 class-action lawsuits and gotten a total of $3.70 for losses of a few hundred dollars (both suits were for credit card overcharge policies). As usual in these cases, I expect the lawyers to make millions and the plaintiffs make a few bucks...probably enough to buy a can of Plexus for each of us.

Let's say that you and your fellow suit filers win, what do you win? Does Honda then have to have all plastic windows replaced? New and old? I'm not clear on what your objectives are with this suit...



While, personally speaking, this is using a sledgehammer to swat a fly...but to each his own! I also don't think this is going to foster any good will between Honda and its customers...I think it's a bad move.

this is ridiculous. Plastic windows have been standard materials for convertible windows for a long time. The S2000 one is no better and no worse than plastic windows used in Miatas to Porsches. They just require a little care - I plexus mine once a month, and mine is in great shape.

What are you going to sue for next - your paint getting chipped from rocks? Tires wearing out too soon because they're performance tires?

I want to see how this goes down, I'm quite sure this is the first time Honda worldwide will be dealing with. Hmm, who knows ... All US model cars might get free window glass upgrade, however I do doubt AHM will go to such a compensation extend.

yes, but my cousin's miata's rear plastic window doesn't distort your view, ditto with the porsches. However, the s2000's rear plastic window becomes too warped and you can't really see clearly out of it.
