I thought, from reading Schatten's post, that Tim was working something out with Spyderfish? Am I to understand that NOTHING has changed since this thread started?

 

Listen real carefully here and I will attempt to explain it as best I can so that you may understand my point...

It has become quite obvious that you have gotten nowhere with making phone calls, emails and posts on this board...I see that your only option left is to actually go to Atlanta and TALK to him face to face, because it has became fairly clear that he is not going to bring or send the money to you...In past experinces dealing with someone in person produced more results than over the phone...

But hey, if $3500 does not mean anymore to you than doing a little work and trying to recover it yourself, then let it go, because I don't think you will have much luck trying to get it any other way...

I know it sucks being out the money and you have been screwed pretty hard and I also think you have been more than patient in waiting for an outcome to this whole event...But, to be honest I don't think what you are doing at this point is going to produce a positive end result...

If it were me and I was only out a $100 I would make a few phone calls and if nothing happened, then I would get in my car and drive to where ever the person lives that had my money and collect it myself...But that is just me...

spyderfish, What I would like to know is if Tim/MG Racing has contacted you since the start of this new thread with regards to some sort of resolution?

 

I am not really sure a face to face meeting would ensure prompt repayment. What is a face to face meeting have that would necessarily make someone write a hopefully good check? If all that has taken place has not resolved this issue, I am sorry, but I do not see how anything short of filing charges would solve this issue.

Also, Tim's statement to fold the business seems to be a way of saying spyderfish will not be seeing any money from MG Racing; where is the resolution?

 

purge...i must be dense....or maybe you have a lot of time and money on your hands where you can just take a trip to retrieve 100 dollars. do you know how far away i live form tim? all that wasted time money and energy for what? do you think he's just going to hand the 3550 dollars over? can someone else comment on this. if the majority thinks i am wrong then i am dense. you are right this post may not help me get my money. i have already realized that. 1. it was an atttempt to go public to get my money. 2. it was a heads up to you all. 3. but now the main reason i posted was the for the spin doctors who are downplaying what happened as a simple...misunderstadning. it was thievery. and i am a little tired of those using the " poor baby tim" attitude ...aaawwww...see now i'm gettin negative and i do not want to do that but that's what some of you are doing. aaawwwwww...poor baby..going thru a bad time..it's o.k. that you stole......i feel so bad.....well why not feel bad for poor baby spyder and start a collection pot for poor old me?...wwwwwaaaaaaaahhh!

 

Going there to get "face to face" with Tim may be a far worse thing to do. Do you guys know a fellow by the name of John Hennesey? He builds those Hennesey Venom Vipers. Apparently, he has bilked hundreds of thousands $$$$$ from several of his past clients. One of those clients actually went to his establishment. It almost came to blows and the client was (or nearly) physically thrown off the premises. Law suits and counter law suits have been the result. As this fiasco has been unravelling, certain parties have been getting more and more agitated and quite defensive. I'll leave you to decide who is who.

 

o.k. tim if you do not send me my money by friday july 5th i will be taking action to file charges against you. maybe get a little extra for my aggravation. also for those of you still feeling sorry for tim i should explain that he told me that this was not the 1st business he owned and his dad has a successful pawn? shop. each time i had called tim...go ahead and call that number listed...he is so swamped with customers ringing up that register that i wonder why he can't pay me. if that's not his dads place then at least he has a job.

 

spyderfish, you should pursue this in a court of law. I understand that you aren't in the situation where you can just pick up and go to Atlanta for a court hearing but it seems that you have an open and shut case where there's no chance of losing. You can sue him for the $3550 plus attnorey fees, court costs, travel expenses to Atlanta, etc. You should also contact the Better Business Bureau and even his local and state authorities regarding the three NSF Checks. I don't know how the laws in Atlanta or GA work, but in some states, purposely writing a NSF Check is considered a criminal offense. Someone I knew went to jail for that in FL. Also if I'm not mistaken, since this transaction took place across different states, isn't it mail fraud?

Sue Tim Hamm/MG Racing before your time limitations run out. Report him for fraud to the Better Business Bureau, local and state authorities. Seek legal advice to see how far you can take your case and punish Tim for defrauding you. Seek out other people in this forum or elsewhere that may have been defrauded... good foundation for a case action law suit.

By the way, its funny... When I was planning to purchase something from Tim, he asked me also if I was asian? He said judging by my first name and voice, you seem asian... He immediately said he was Korean and that all Asians are men of their word. Weird, my first name is Tommy and I grew up around Hispanics, I sound far more Cuban than an Asian. And I never questioned his word. ??? Maybe, it's Tim's little way to gain people's confidence...

 

The return address/business of the air filter sent me by MG Racing instead of the rotors was a luggage company.... It was weird.
