Default Dealer Mess Up!

AS MOST OF YOU KNOW ABOUT 2 WEEKKS AGO I BOUGHT MY SECOND S2K. WELL TODAY I GET A CALL FROM THE DEALER AND THEY SAI THERE IS A DIFFERENCE OF MY PAYOFF AND WHAT THE CREDIT REPORT SAID OF 7800 DOLLARS. SO MY QUESTION IS WHAT CAN THEY DO TO ME , I HAVE A CONTRACT AND EVERYTHING AND THEY ALREADY SOLD MY TRADE IN. SO I GUESS WHAT I WANT TO KNOW IS ARE THEY SCREWED BECAUSE THEY DIDNT FIND OUT FIRST OR WHAT? BY THE WAY THE THIRD DAY I HAD IT I DROVE TO PENSACOLA FOR SCHOOL SO THE CAR ALREADY HAS ABOUT 2200 MILES. THNX IN ADVANCE FOR ANY INPUT. JEREMIAH

Tough cookie. They signed the contract, they made a commitment. I'm sure they'd tell you teh same thing if the roles were reversed.

Very simple: A dealer must get a "difference in payoff" form signed by the customer, stating that if the payoff is actually different than when the deal was done, the customer is reponsible for the difference. If this formed wasn't signed, it's their baby....

However, here is problem...have you received your plates yet? And do you get them through the dealership? If you haven't received your plates, and you get them through the dealership, they may hold your plates until you pay the difference.

Not much you can do in that case.

Hang on, did you say the payoff was OFF by $7800??

If this was the case, you didn't catch this when they did the deal? That is a pretty big amount.

If you signed a purchase agreement, and likeweise told them a payoff amount that turns out to be different ($7,800 different).....then you are stuck for the difference. It's all about the X's and O's.....and of course your John Henry. If you didn't sign anything with the figures on it, then the dealership may have to eat it....

I did not sign anything saying if there was a difference then i would cover it, the dealer is supposed to check out all of this before the deal is done. I am contacting a lawyer tomorrow about this and some other stuff happening in my life right now. So my question to everyone is Are there any lawyers in this club to give me some free advice? If so feel free to post here or Pm me or whatever you wanna do. I dont see how they can expect me to hand them 7800 dollars. But i know they are sweating this and it will probably be in court but oh well. Well i will keep everyone informed about this and let you know how it goes.

well here is another update , i called honda today and talked with the guy there and he said it clearly states on the back of the buyers order that the buyer (ME) is responsible for the difference, but they said that since it is half their fault that they would split it with me. Does this sound like a good plan to just live with? Well this is probably what I am going to do and will let you know what ends up happening.
