uhm. work to get your money back quickly, wash your hands of the entire deal. dont even waste your time sueing. go down to your local honda dealer (where smiles are born) and lease a nice new 05. problem solved. laters. and best of luck. dave
I'd say at least pursue criminal action if not a civil suit. Without seeing the paperwork, it is hard to say what transpired. If in fact they broke the law, the proper authoritys will take necessary actions against this dealer. You may even be eligible for compensation.

I`m a lawyer myself and I really say you should talk to your lawyer who knows state laws perfectly. The dealership is
ed up. And the unethical part of the case combined with their entirely unacceptable way of dealing with you - it all will surely work for you. Sue them

it is ABSOLUTELY impossible that the dealership would've missed and sold the car that had been in transaction for over a week with a client from SAN FRAN FCKING CISCO! They would've talked about it and probably everyone in dealership knew that S2000 was going to be shipped to CA!
This is BS! They sold the car to this poor guy then realized that they could sell it at higher price so they took the chance. Thinking that there isn't anything this guy could do all the way and far away from CA!
I don't want to paint the rest of te dealerships with same brush but stories like this is precise reason why stereotype about car dealerships exist.
I say hit em with everything you got. Teach them the lesson they deserve. We are behind you 100%. BBS, Consumer Reporting agencies, Attorney General and Lawyer. Whatever you have to do to get attention on this matter, Do it!

but if this is a major automotive group I can understand how the wholesale department would not be aware of the sale. If it truely was sold by the wholesale department, it would be a simple matter of having them go back to the person they sold it to for bargaining of the car back.......or they can refund your money.I doubt you're going to get anything more than a complaint filed against them with the BBB - which they'll be able to satisfy/resolve very easily by showing they've refunded your money.
I also doubt that you're going to get that S2000 from them

Eventhough I'm giving you what may seem like a grim outlook I want you to know that I sympathize with you. I do think this is a load of
- if I were the dealer in this situation:1. this situation never would have came about
2. I'd be working to get that car back, despite the fact I know I couldn't be touched legally - I'd do it for customer service, even if you live across the country from me
P.S. I still find it very funny that you've had a deposit on this car for 3 weeks and they left the car on the front line
- I find it even more pathetic that the manager is blaming the sales girl for it
Like I mentioned before: there is no way that they wholesaled the car. They offered to sell me the car on the spot when I inspected it for Eric, which I though to be a little weird concidering them knew I was representing another party. Make them give you this car for the deal or get'em good.

i was successful in purchasing a car out of state, it was cheaper to buy it from a dealer in VA and have it trucked over than finding one and buying it locally. the deal was verbal, did all the transactions via FedEx and Fax.
i hope your experience doesn't keep people from buying cars this way.
one experience I had was I went to go test drive a car, got in the sales cube and were starting to do a deal - then when the salesman came back from the manager's booth, apparently another couple who test drove the car a day before were finalizing their paperwork on the car - or must have made a better deal. oh wells - in the end i ended up buying my car from a private party, got a better deal w/ financing and a car in much better condition.

Alright guys lets not bash all car salespeople. I have been selling cars for a long time and not all of us are "scum". I am sorry this happened to you and I hope you come to a mutually satisfying resolution to this bad mistake on their part.
