Help with Stealership
actually the document being faxed or not has nothing to do with it. You have a verbal AND written agreement on price/sale. It does not matter if it was faxed or not. You really need to contact an attorney about this. You may be entitled to compensation above and beyond a refund.
Oh also...if they even cashed the check they may also be in bigger trouble. The dealership is playing hardball because they don't want to pay anymore money but you MAY be entitled to more. Don't back down without talking to an attorney. In some cases merely a phone call or a letter from an attorney will be sufficient to get additional compensation.

Filed the complaint with BBB in Cleveland. Consumer Protection Agency in CA said they will help also. CPA was dismayed, even the supervisor said they would handle it personaly. Also said I should consider getting a lawyer to sue them for breach of contract.

I hope you kick their ass. I hate car sales[wo]men. My sister dated one and I can't even start to tell you how jaded I became by seeing him in action. ABSOLUTE SCUM.

Please don't stereotype a group of people off of one. Just because one dealership screwed up doesn't mean they'll all do that. There are some dealers on S2Ki that do quite a bit for this community
I'm sure if you contact your attorney he'll take care of everything such as contacting the bank etc.
Don't forget the interest you are currently paying on the credit card.
Also I think a lot of credit cards allow you to cancel a payment if you have not received the goods. So you may want to ring the credit card company and cancel that $1000 deposit you haven't got back.
Oh and if you do contact a lawyer/attorney/whatever for legal advice, I would not make any further posts to this thread until the matter is resolved so you don't hurt your case.

did some research on mail fraud and looks like according to USPS this may qualify as "failure to provide" and they would be in violation of federal mail fraud law.

I've worked in a dealership for a few months. The moment the papers are signed or transactions takes place, managers immediately know what is going on with the subject car.
it is ABSOLUTELY impossible that the dealership would've missed and sold the car that had been in transaction for over a week with a client from SAN FRAN FCKING CISCO! They would've talked about it and probably everyone in dealership knew that S2000 was going to be shipped to CA!
This is BS! They sold the car to this poor guy then realized that they could sell it at higher price so they took the chance. Thinking that there isn't anything this guy could do all the way and far away from CA!
I don't want to paint the rest of te dealerships with same brush but stories like this is precise reason why stereotype about car dealerships exist.
I say hit em with everything you got. Teach them the lesson they deserve. We are behind you 100%. BBS, Consumer Reporting agencies, Attorney General and Lawyer. Whatever you have to do to get attention on this matter, Do it!
This just boils my blood!
