In many states, laws have been passed that require an insurance company to make a claim check payable to both the insured and lienholder. So in your state, I would assume that law exists. However, some lenders are more strict about it than others--discuss this with your lender and see if they're willing to endorse the check to allow you to complete the repair as you see fit. If not, you're stuck going back to OEM. In many cases, the insurance company has a choice of either making the claims check payable to the lienholder and the insured (like yours) or making it SOLELY payable to the body shop to prevent any delay in the repair process. You may want to ask if this option is available as long as your repair shop is cool and will go along with the upgrade.
