I'm sorry but I don't understand why you wouldn't say "I wasn't racing". You don't want them to get you on camera saying that you were racing? But you don't want it on camera denying that you weren't either? What logic am I missing here? So are you saying you were going to say that you were racing? That's why you kept your mouth shut.

This Link1 has both exhibition of acceleration and racing listed but next to EOA it says "Exhibition of Acceleration (NO LONGER OFFENSE 9/01/2003)"

Thanks Winter....that should help out alot!

Oh yeah, I never had my rights read to me when being arrested...anything wrong with that or what?

I contacted the local DA and the lady said they didnt have my case yet. I told her what happened and she asked if the other driver involved in the "race" was arrested. I said no and she said '"oh, this will probably turn into nothing." ....... I hope shes right.

Police are supposed to read you your rights before they throw you in the slammer. If they don't have any evidence of you exceeding the speed limit, unsafe lane changing, tailgating, burning rubber or anything else, it just might be dismissed.

An S2k is considerably faster than a slow ass Hynduai. If you did not pull ahead of the other car and you did not exceed the posted speed limit, that would prove that you were not racing due to the fact that the S2K is capable of easily pulling ahead of a slow ass Hynduai. On the other hand, you probably pulled ahead of the other car. If you were not speeding or exhibiting speed, they have to prove you were racing. They don't even have the driver of the other car.

lol ive been arrested twice for street racing since i got my s2k...both cases thrown out...second one was ridiculous, cop said i was racing a hummer...threw me in the back of his car and i spent 8 hours in jail....after all was said and done..state attorney laughed about the whole thing and threw it out...both times i had a freind in the car as a witness....the biggest adivce i can give it you is this...show up to your pre trial early and talk it over with the state attorney...make sure to give all the faults on the cops part...talk about how they have no radar with speed, tell him you have an eye witness, and just be real friendly with him...getting your case dropped in pre trial would be the best thing possible...good luck man, your gonna need it...with the laws they have now "street racing" will screw up your driving record for good...oh yeah and get ready to be flammed...when i wrote out my story alot of people on this board were @ssholes, even though i wasnt racing....so if you want any other adivce or wanna talk to me about it throw me a PM i have alot of experience in this area lol...

May I ask on what you based this statement on? I'm not a lawyer but from what I've read the police only have to read you your Miranda rights before they question you, not before the take you to jail. Unless they plan on questioning you (which doesnt seem necessary in this case) then I dont see why they would have to Mirandize you.

This seems ridiculous to me. Id sue the city for the inconvenience of being thrown in jail.

how can they just throw you in jail like that? it seems like you were Rodney King and they just whacked on you for no reason. Seems kinda scarey to me. F**KING PIGS!!!!!!!!!!!!!!!!!!!!!!!!!!

You weren't even speeding either. Is there a law for fast acceleration?
