It has to do with the the Writ of Habeas Corpus. The cops can hold you for 3 days without a charge. Its meant to keep someone around while an investigation occurs, so they don't flee.
BTW, Rodney King is a VERY BAD example to use. He's was going 90+mph, doped up and charged at the cops (of course that wasn't shown on the news channels....b/c then it just looks like some guy going after cops and then getting a beat down...which he partly deserved).

I think using the Writ of Habeas Corpus to throw somebody in jail for not speeding is ridiculous.

As far as Rodney King goes, the cops didn't need to beat the shit out of the guy.
I realize Rodney was hopped up on PCP and possible other drugs. It doesn't give the cops the right to beat him to a pulp.

Think about when people hunt bears. they dont beat the shit out of it. They should have used elephant tranquilizers or something. The fact is the cops wanted and got pleasure out of beating Rodney which is very F**CKED up.


i used Rodney as an example because it was racial. yes he broke the law but the cops took it to the next level and abused the guy because of race.

in the case of this thread, it appears to me that the cops picked on this guy for no reason. Basically because he had a sporty ride.

even if nothing comes out of it... you still lost $750?? for your bail.. and you had to spend time in jail, and there's probably a lot of embarrassment.... if and when they drop the charges you should sue the hell out of them..

I will get my $750 back when I show up for court. I didnt use a bondsman because I was innocent from the start and I dont want to spend a penny more than I have to inorder to take care of this. I personally think that the cop was jealous and looked at me like a little rich kid (which I'm not) and decided to teach someone a lesson (the wrong person) I will take this matter in my own hands after this case gets thrown out. I plan on researching my rights and pursueing the worst penalty for the cop that arrested me.

Habeas Corpus is a constitutional writ brought by someone to get OUT of imprisonment, not something used to put someone in jail. That aside, Badconexun, this all depends on the state's laws, the provable evidence , etc..., you may have gotten a a raw deal on this and I hope things fall your way. But the only advice you should listen to on a freaking car board is to get the best attorney you possibly can. As to sueing the city for everything it's worth, do you people realize how many people are in jail from a night to a couple years who are eventually found innocent? Do you really think they are all just cleaning up afterwards? LOL... Besides litttle issues like cost/benefit, governmental immunity, how a jury will view a kid originally collared for street racing, blah, blah, it's not gonna happen in the real world. Good luck.

OMFG U better tell your lawyer that the cop did not read you your right and tell your lawyer the other person was not charged with street racing just you were. OMFG LOL What a dumb ass cop he pulled you over and charged your ass because u were young and driving a car he can't afford. This case will be dropped for sure don't worry about it. Anytime a cop arrest you they must read you your rights or they'll get in big trouble. Also make sure you make a complain to the police station and ask them why were you the only one charged.

The don makes my point better than I ever could, Bad. Please spend your time looking into good attorneys and getting the base charge dropped, and not getting retarded info about Miranda rights from S2KI.

Just get a good lawyer and you'll win in this case for sure. Also make sure to tell your lawyer the cop did not read you your rights before taking you to jail and ask your lawyer why wasn't the other person charged.

My friend's a lawyer and he said the cop has to read you your right before they arrest you or this will go against the cop and the case will get thrown out. Also remember to be honest to your lawyer tell them everything don't lie to them or they can't help you win the case.


Weezie you know Badconexun rights was voilated. if you don't believe me call you local lawyer.
