we all have our share of stupid law(that's your state included) but you have to put thing into perspective:

we have a very high density and most of the business, places, etc is connected by hwy system, if we don't enforce it tightly it would be unimaginable to drive.

street racing is a plague in LA, there's street racer crash almost every week, it's not something you see in movies, it's happening on the street your kids playing ball on, it's happening right by your wife's workplace and your grandmother's retirement home.

street racing is fun and all until some idiot crash into someone, let's not forget the same demographic are also fueling the stealing and theive ring int the area.

i am glad they crash street racer caught on the street

i am glad they impound car with no cat

i am glad they crash car with "hot" parts

to the OP: you can pop it there or they can tow it to the station and stripe search it, the bottom line: they will get it neither way

5th amendment - No illegal search or seizures without due process.

Due process can be defined as a search warrant, or even probable cause. But don't let them use probable cause to let them do whatever they want. If you get pulled over for street racing then they would have probable cause to pop you hood and see what you have.

But if you were just pulled over for slightly rolling on a stop sign, that does not mean you modify your car, so there would be no probable cause to pop your hood.

You should always cooperate with law enforcement, but do not be afraid to exercise your right to say no if you feel they are abusing their power.

well i dont street race. the car looks like i street race but i just like the look of it. the wheels for wider tires over stock. cf hood because i picked it up used and for cheap. original hood had too many chips and rust spots

i dont mind popping my hood but there was no reason for him to ask me to pop my hood when i wasnt doing anything related to why he needed to see what was under the hood. i guess you can go as far as oh your covering your plates and that means your hiding something. well now i have the tinted cover off and up to date tags that he didnt even care about. my record is clean. i dont speed anymore and all tickets been cleared now/off record (speed back in high school days)

to everyone saying that it is an illegal search... to plainly put it our laws make it so it is not. it is sad that car enthusiasts are lumped in with the entire street racing scene and all the other illegal aspects of it, but it is just something you have to deal with.

law(s) were passed, if i recall correctly, 5 or so years ago stating if you have modifications on your vehicle it gives the officer enough suspicion to warrant the popping of your hood. if you refuse to do so, you can be arrested on the spot. this is a FACT. if you have nothing to hide, then pop it and be on your way. if you are harassed for "illegal" mods that are in fact legal, then take it to court and fight it. how else are you going to prove the officer is not doing his job correctly? you don't hear about it every day because it's not glorious enough to make the news, but this does help in finding stolen parts, illegal modifications, etc.

i used to own a wrx fully catless, suspension, wheels, bov etc. it was loud and brought attention wherever i drove it (good and bad). i understood the risk i was taking driving around like that - emissions ticket (big $$$), profiling, illegal modifications, >95db exhaust etc. the bottom line is BE EDUCATED ABOUT WHAT YOURE DOING. i knew the laws and i knew what i was doing. i was ready to face the consequences at any time.

It is your right to refuse a search under your hood. the cop can only due so if you allow him to. he needs to tow your car in a impound it to do a search under your hood.

also your right to refuse searching of any locked compartment of the car including the glove compartment(s) and your trunk. however if an LEO did ask me to open any of those things I would just show them.

I think you'll be SOL.

If you were going 4 mph over the speed limit and the officer is frustrated that you won't pop the hood--whether or not you should have to--he can just deal you out a speeding ticket and be on his merry way. It doesn't matter that other people were driving faster, you were still technically speeding. Is that a victory for you? I think not.

The law is not enforced as it is written, so we are all offenders. This becomes a huge fundamental problem if any police officer ever has an agenda other than public safety. I think enforcement is the issue.

Instead of having speed limits 65 while everyone travels 75-80 and slams the brakes when they see a crown victoria, I'd rather we made the speed limits 75 mph or 80 mph and ticketed everyone driving 5+ mph over the limit. Everyone knows the standard and everyone follows it.

oh i try not to speed much in the accord. gf gets made when i drive speed limit and in the accord i just dont feel the need to go fast in it compare to my S or RR so she drives her car. i like to be pass anyways. in a z06 lol

bumping the speed to 75-80 will allow people to going even faster. since we already know we can go a little over. so with the new speed limit people will go 85-90. 85 ok 90 is pushing it.
