Wrong. If the S2K was going 70 closing on the 65MPH SUV, the odds go way up that the SUV would have seen him. The odds also go way up that even if the SUV still changed lanes without a signal that the S2000 dealing with a 70MPH speed and only a 5MPH differential speed would not have lost control, in fact a tap of the brakes rather than a swerve would probably have worked.

95MPH is a speed for the track, or maybe an open desert hiway, not for moving through other traffic. You risk your life but far worse you risk innocent people.
You are taking into account that the SUV even looked. You also assume that there was a massive differential in speed. I never stated that the SUV was moving at the speed limit. It was moving probably between 80-83 (we were doing 85 and were making up a little ground on it, but not much). There was no signal, no nothing. It was not a standard lane change. It looked like one of those "double lane change" tests you see on Car and Driver TV (rather reckless looking in its own right....tires squealed and the right side suspension even compressed upon the change in direction). More of a lurch than anything. Had the S2000 been moving 90 and the SUV 83, a simple tap of the breaks would have still created contact between the two cars. He had to swerve to avoid contact......dont even question that.

I do agree that speed differential increased the chances of the SUV not seeing the S2000, but it was not great enough to really account for the driver not seeing the S2000. You are stating that the right of way is forfeited once speeding.

Once again, given similar circumstances (position, direction, etc) with the only variable being speed, the accident was unavoidable.

I am not condoning the S2000's speed. I would never go that fast, and think it is in itself reckless and dangerous. But it was not the cause of the accident.

Kind of pointless arguing my point to people who did not see it in person......a video would persuade everyone here.

Anyhow.....the main point to this post was to see if anyone had any info on whether this individual is indeed a member, and to see if he needs my statement. If this arguing continues much further, I might just lock the thread.....
