Default Some people can't learn their lesson

So I got another ticket. In the second most avoided place I know in LaMirada, Ca. Naturally I am pissed about this because I was going 10 MPH over posted due to the fact I was trying to get to a date with the greatest girl I have ever dated..

Anyways the catch... The officer put the posted speed limit, checked the laser box and left the aprox. speed empty.. I literally do not know how fast I was supposedly going, or WTF I am suppose to do.. BTW this was a sheriff. The only thing else he put was "infraction 2350 cuc Basic Speed Law". Can I fight this? I mean can cops just hand out tickets with no speed on it?

Regardless, that leaves me with two tickets.. Hopefully I can defeat at least one and traffic school the other. However this time I have learned the lesson the proverbial hard way.

I'm no lawyer but would tend to think that the cop would be required to document you speed. Most places vary the fine depending on how much over the speed limit you're going. If he doesn't document how fast you were going then he has no proof that you were speeding. At least is seems like that's how it ought to be. Also, find out what that "infraction 2350" is.

He may have just given you an out. Let us know how it goes.

Hosh, I can't be sure of course, but I'm guessing "2350 cuc" was a messy way to indicate 22350 cvc. That section of the California Vehicle Code is the basic speed law, sort of a catch-all code that says it's illegal to drive faster than weather, visibility, traffic conditions, etc. permit, without regard to any posted or prima facie speed limits in effect. That's how you can still get a ticket even though you're otherwise within the limit. Anyways, there's tons of case law and information about it out there, but in any case I'll bet that's what the chickenscratch on the ticket refers to. Good luck.

However how could I get that inffraction without my speed on the ticket??

I don't know how that works to tell you the truth, but I'm sure there's some info somewhere that speaks to whether that flies or not. I can think of some hypotheticals where a cop could argue the speed you were going is irrelevent, like say if someone stops for a red and you plow into them... you were going too fast to safely stop regardless of your actual speed. But in your situation, without knowing all the details, whether any case law applies and so on, I really can't help you out much. The interesting part is that it appears he radared you if I'm reading that right. You would think like others have said that he would have gone ahead and noted it on the ticket then, but I really don't know. See what you can pull up on the web and you might get lucky and find a similar situation discussed.

i'm guessing its like just driving at an unsafe speed even if there is no posted limit

Dude even if you do get screwed in the end, it was for a good reason.
