While it may not be the law to notify a potential buyer that the car has a salvaged title, I have to believe that if specifically asked about the title and the guy lied, then it's fraud.

Seems to me like you should have a stong case.

That just sucks! I sell cars and there is no way in hell we would even think about doing something that slimey. There has to be some kind of repercussion, talk to you're attorney. Good luck!

yeah but thats just your word against his. if it were me personally id still contact an attorney though.

No offense to those that live there (and check out my location), but all I have to say is SC is the most screwed up place I've ever lived. It's only a matter of time and I'm history. The laws here are just fvcked up. I'm paying increased insurance rates just in case I get nailed by someone who doesn't carry insurance, and SC has not way to track who has insurance and who doesn't once they get their tags. Meanwhile, lawmakers are too busy fighting over a stupid flag and whether bars should only serve from mini-bottles to do anything that would actually benefit the general public. Man, can I say "Palmetto pride" or what?

Sorry for the rant.

Thanks for everything guys. I'm not really sure what to do. I'm friends with the guy that originally sold him the car and it was salvage then too. I asked him about it when he called me today and he was like, "Dude, I thought he told you." So I dunno. I don't really feel like the kid was trying to screw me and neither does Chuck, but his "forgetfullness" has caused me a lot of trouble. You guys really think I should persue it even if it were a mistake?

hell ya! what type of question is that. you want to take a 8 thousad dollar mistake? tell the bastard he owes you 8k or return the car....if not take it to court.

These statements are contradictory. If he made the first statement then he was not forgetful and was most likely lying about the condition of the car in order to get you to pay more money than it is worth. At best he can claim that he didn't know it had a salvage title either, but he is still liable for his statement of condition. Are you sure that he told you it was accident free with a clear title? When I say "sure", I mean are you sure enough that you are willing to swear to it under oath in court? If he didn't, then you need to check your state laws about the disclosure of a salvage title. In such a case, if he is required to disclose without being asked, then he is still liable. If he is not required to disclose without being asked, then, unfortunately, I think you're out of luck.
