Default Warranty Related Question

I know there are a lot of topics on warranty denials, but mine is a little bit different, because I haven't been denied yet.

I was on the freeway driving at normal speeds 70-75 (yeah I know the limit is 65, but 70-75) is normal is CA.. haha And my car sputtered and died.

I had the car towed to the Honda Dealership and they asked me what happened. Before they even looked at the car, the service rep was telling me about Over-Reving, etc. Which to me, already means they are going to try and blame it on me, before even looking.

So here is my car situation. I bought the Car in August of 06. It's a 2003, and it is CPO'ed. I took the car in for a loud ticking sound several months ago, and they said it was normal Valve Train noise.

The dealership I took the car too, coincidently was the same dealership the car was originally bought it. Well, low and behold, it was brought in twice, for the service engine light (shows on the paperwork of the previous owner).

So here is my question. If it is denied coverage, what should be my immediate steps, to get it resolved as quickly as possible. Can I use the previous Engine Lights, and me taking it in for the ticking sound, etc as something happening previously and not me?

I am just expecting the worse, and preparing for it... I am praying it's something simple.

CPO'ed.. So 7 years, 100,000 miles after intial sold date. So I have until 2010 or 100,000... whichever comes first.

you could use the paperwork to try and say that there were previously documented problems. if they still have problems, try to go up the chain of command to eventually the service manager. be polite but firm. dont give in. if they still deny you, go bring it to the better business bureau, but i dont think it should get that far,i think when everyone gets a good understanding of what happened, your car will be fixed under warranty.

my dad and i had to do this for my sister's civic that had a dash popping up. we went up to the service manager and he eventually fixed it for us.

So, do I leave the car at the dealership, if I have to fight warranty coverage? Or do I tow it home?

So the dealership just called me, and said that there is a hole in my #4 cyclinder. They said they are getting a Honda Care person to come out on Friday. I know I have seen threads about incidents similar to this. Can someone give me links to these threads?

When I do a search, I get the first page of results, but when I try to go to the next page it always gives me an error message "We're sorry, but something went wrong. We've been notified about this issue and we'll take a look at it shortly."

It's standard for hondacare to send an independent inspector. they will be the one making the coverage call.

So, based on all of my searching on this board, it seems like it's a 50/50 shot on warranty covering the damage.

Does anyone know of a lawyer who does these types of cases, or know of any lawyers who have helped get things covered under warranty? I have seen a lot of issues like mine in 00-02 cars, and mine is an early 03.

I am basically preparing for them to deny my warranty, and want to take immediate action if they do.

Thanks again for any help, and any names of lawyers who can help me.

BTW: I have my own personal lawyer, but they know jack about cars.. haha
