Default Broken 4.44R pinion?

I bought a 'new' MotorKlasse 4.44R final drive the other day from a fellow board member; when it arrived the the pinion gear had a chip from one of the teeth. See the photo below:

Can anyone please tell me if this will be ok to use or should I get my money back?

Chris.

It will probably make a terrible noise if you install it.

First: the part was sold as new and is isn't, if you paid "new" money you should get your money back.

No doubt.

FYI
In the pic is my old 4.10 pinion, factory installed.
It didn't even wear at the point where the damage is on your 4.44 pinion.
Does this mean I would install that 4.44 pinion in my diff?
Hmm.. maybe. How does the ring gear look?
First thing I would try is get my money back though.
And complain about handeling & packaging!
