How exactly where the splines broken? I had a very similar problem with a remanufactured joint (on a different car) where the CV joint would just spin and grind when putting the car in drive (auto). I took the joint out and it was obviously the inboard CV joint since the boot was twisted around itself but the joint seemed to work and feel fine off the car. Only by really torquing the joint would it slip. Since I bought a complete remanufactured axle I just exchanged it and put a different one on, so I never got a chance to pull the boot to figure out what exactly caused it, but it was really strange. It sounds exactly like what you describe and I was really wondering how the heck the joint could feel so solid and smooth off the car but sound like it had completely exploded when it slipped on the car. When you really turned hard on the housing it would finally give and slip into the next "groove". Sort of like a stripped bolt or something. Sound similar?

My guess is the base ring of the tripod cracked (at the root of a finger) and only opens when a large enough torque load is applied.

i'm telling them to give me the old parts, then i can open it up and see the exact failure...right now u just see the shaft hanging loose inside the boot.

That sounds a lot more catastrophic than what happened to me. Sounds like the shaft pulled out or broke. I'm surprised it even turned when you had it up to test the operation, maybe the small torque from turning by hand was being transmitted through just the boot to the housing. Too much torque and the boot just slips where it's clamped to the axle or housing. At least it's not the diff. Should save mucho $$$.
