Default What to do with an Ebay gone bad

I bought a used chin spoiler for the S2k off ebay. When it arrived it came broken in two pieces. I have since talked to the seller. Seller sais he put in a claim into the shipping company to replace the value of the part due to the damage. His claim was denied because it was due to his mispackaging of thepart. I have asked him if I can send the part back to him and get a refund. he said he was going to pay me back but didnt want the part back. This was 3 weeks ago..now I cant get a hold of the person and it looks like he is ignoring me....

Has anyone come to this situation? What to do?

Thanks
Ian

Ian, I'm afraid you may be up shit creek if you know what I mean.

Thats why if I ever deal on E-bay I get ALL their info. Address, number, everything I can so I can easily go after them if I have to.

Call their local authority and file an internet fraud report... file to FBI as well hehe

Did he leave his work number with you? Let his boss know too...

I dont think he defrauded you - I do think that the right thing to do would be to pay you back though. This exact same thing happened to me with a 1/18 model, the guy said dont worry about sending it back, and refunded me the diff of what I paid and what it would have cost for shipping to return it.

A reasonable person will refund you.
