I do my inspections with the top and windows down. They measure the windshield instead.

That sounds like a good idea for me. I didn't realize when I bought my s2k that it has heavy tint on it. At night you can barley see out the back window on the top, so I should have the top down when I go in since the front window isn't tinted much.

the issue is that windows were the only thing the car failed, so of course if i bring it back all they're going to do is just recheck the windows.

chopper's right. when i was a tech and did inspections, people did that all the time. we knew what they were doing, but it covered our ass, so we were fine with it.
the actual glass is not 100% translucent, so the tint should always read darker than it is. that being said, i don't know if the law is "total light filtering percentage" or just "percentage filtered by just the tint." i'll ask my wife tonight, she's a lawyer; not a traffic court lawyer, but she might know where to look or who to ask.

I realize this, but what i'm saying is pull your door panel off, roll down your windows and then unhook the window switch. when you take it back to be tested if they can't roll the windows up they cant test it to fail you. Again, you don't legally have to have windows to drive a car so they can't fail you for that.
