Default Help?

Long story short. My buddy got rear ended in his DD RSX. The lady gave him fake insurance and everything. There was no police report because they were in traffic and wanted to get things going and be on their ways. She told him that the car was her sister's. License plate is 833SSL. And also got her name and DL#. Any help would be appreciated. Thanks.

Call the cops - tell them it was a hit and run. His word against hers.

Unfortunately since there was no accident report, if this person was a complete dick, which it sounds like, they could just claim it never happened. If that's the case, and you can't get a police officer to back you (unlikely), or any witnesses, it's going to have to be handled in small claims court, and it will essentially be his word vs. hers.

Honestly thinking about it, the best bet will probably be to contact his insurance company and let them handle it. They should do some sort of investigation, and hopefully if that doesn't work, he has some sort of uninsured motorist insurance or something. You could run a background check and get this persons information, but I imagine the insurance company would do the same.

EDIT: I'd also contact the police, even though they probably can't do anything, at the very least the events would be on record. They won't be able to say who's at fault, but it's better to be proactive, then defending yourself if she reports it first.

The insurance thing is a pretty good idea, and would likely be the least hassle.

However, if there were damage to both cars, then it's not exactly "his word against hers".

If he doesn't have any witnesses, and with no police report, that's exactly what it would be. Who's to say he didn't back into her, or any other unlikely scenario. There are some pretty unscrupulous people out there who would say or do anything to save a buck.

Call your insurance and file it as an uninsured motorist claim. They have a building full of lawyers that can/will go her for the damage. You will, unfortunately, have to pay a deductible to do this, but in the long run, it will make your life easier.
