You will, unfortunately, have to pay a deductible to do this, but in the long run, it will make your life easier.
This really is the most painless process to go through...if there is something that can be done, the insurance company *will* do it... they want *their* money back, and will fight for it.
I had to do this once, when a lady hit my car, her vehicle got disabled and left at the scene, she went home. Called the cops, got a police report, went to her house w/ the police and got her insurance info. Her insurance refused payment because she was on prescription meds and should not have been driving, therefore voiding her insurance. Called my insurance company, paid my deductible and got a check back 3 months later for the deductible refund.
And that's why you always keep a small camera in your car or a chasecam setup running. I agree with what everyone else said though, police report followed by contacting insurance. The police may or may not back you but if they go investigate and find that the lady's car was all smashed up in the front with paint matching your buddies car it should be pretty obvious it was a rear end and they are at fault.

I second all the comments on filing through your uninsured motorists coverage.
Three things everyone should learn from this:
Three things everyone should learn from this:
- ALWAYS call the police. I don't care if its a $25 fender bender, call the cops and file a police report. Don't feel bad about it - it's their job, and it's your money and car. If at all possible, don't move the vehicles until the police have arrived.
- If your phone doesn't have a camera, buy a cheap disposable and keep it in your glovebox. If you get in an accident, take pictures of the scene from several angles before any of the vehicles are moved. This may help prove your case later when some scumbag tries to claim that they didn't actually rear end your car. Don't ask me how I know this.
- Make sure your policy has uninsured motorist's coverage. This is not standard on insurance in Texas - you have to ask for it, and it costs a little extra. With all of the uninsured and unscrupulous people on the road these days, the extra $5-10 a month is defnitiely worth it. I've been hit by two people in the last decade who did not have insurance - both times the damage exceeded $5000.
I would advise against calling the police. You did not report the accident when it happened and the police may arrest you for not filing a report for an accident, and most likely they will also get you for leaving the scene of an accident too.
Contact your insurance and tell them what happened. Please remember the police are not your friends in a situation such as this.
