Speeding ticket question...

Default Speeding ticket question...

Okay well i got a speeding ticket this morning... 41 in a 30 (really really stupid, the speed limit SHOULD be 40.. which is the entire reason why they hide on this road.. so frustrating)...

Anyway, on the ticket (not written, electronic so im assuming it goes straight onto their computer system) he put the posted speed as 40.. not 30.. so the ticket literally says:
POSTED SPEED: 40mph ACTUAL SPEED: 41mph

pretty big typo Eh? so.. what should i do? plead not guilty? or should i walk in and pay my ticket for doing 1mph over?

i'd contest it, hopefully you get lucky w the judge, maybe you can just say you're speedo is off that much

isn't the margin of error for speedos like 3%? also, do you have a digital dash? those things together should be enough to show the judge that the ticket is out of order, that the whole damn SYSTEM IS OUT OF ORDER!

If you call the clerk about it, they might just correct it, but if you go see the judge about it, they might just throw it out.

As far as just paying it, I wouldn't do that, since it would still show up as a speeding ticket on your driving record.

Mallory or Tatarevich can probably get it thrown out for $40 and you won't have to show up. If you are good with words and presentable and have time to kill you can request a court date.

Otherwise- I would count yourself lucky and pay the min speeding fine (1-5mph over should be the min on the city's scale).

i've had a 4 over thrown out when i talked to the judge...and a 7 dismissed with mallory...I told the judge i was trying to change lane and didnt want to hit the car in the lane next to me so i sped up for a quick second to change lanes

You could still be charged with speeding bc even 1 mile over is "speeding." You should plead not guilty regardless and fight it, the judge will probably let you off. If necessary, your argument could be that the cop was not competent enough to know the correct speed limit much less how fast you were going...

The best argument for getting out of a 1 MPH over ticket is that the equipment isn't acurate enough to really gauge 1 MPH.
