Surely they'll just replace it with a stock exhaust if it's uninsured. As you're not claiming from your car insurance are you? You should be claiming of their insurance.

AFAIC i'm claiming from his insurance policy

However I don't want my insurance company to say "a-ha. you're not insured [technically] so we won't have any further involvement in your claim".

Depends how much of a jobsworth the assessor is, whether he rings my brokers to check. But as you say, it should be the other guys insurance company that pays the bill.

It's not hard to get their insurance to arrange repairs etc. When I had a ding that was an open and shut case (my car was stationary and the muppet reversed into me with witnesses) I only bothered to phone my insurer to register the ding. The other driver's insurance coughed up for the repairs direct to the repair centre with no quibbles. I think you'll be fine because the vehicle was parked up Only thing to watch out for is that nothing is missed off of the assessor's list or incorrectly identified e.g. expensive exhaust replaced with rubbish one etc...

Bottom line in this instance is you don't have to be insured because it's not your fault and therefore it's not your insurance paying up

That's what I'm hoping. Even if the car was uninsured and not driven, I would still be claiming from that daft tw@t

exactly - what if your car was not taxed and insured and just stored in the garage - as mine has been for the past 9 months?

yup... mine too, he's he got pulled by the police a few days after his 60th birthday for accelerating too fast from a junction... in my nova, apparently he launched it to pull out infront of their unmarked car
