Used Car Problem

Default Used Car Problem

I need some advice if anyone can assist.

Yesterday my father purchased a 2002 Accord Coupe with 55k miles 4 cylinder automatic, clean carfax, 1 owner from a leasing company.

He gave the salesman a check to purchase the car in full.

Last night I drove it for 5 minutes to the gas station with him, revs below 3k the whole time, I pull up to the pump and I smell a burning smell. I pop the hood and their's smoke, a good amount and it smokes for about 5 or so minutes. I check the oil just in case it's low but seems alright. Couldn't determine where exactly the smoke was coming from it was dark and it was about to storm.

I recommended my dad to go to the bank today and do a stop payment on the check and take it back to the leasing company which is less than 3 miles from our house. The car has 10 miles on it since it left the dealer and hasn't been titled over to us yet, It was going to be titled this morning.

If the bank is not able to stop payment or it's too late and the dealer gets ugly like they always do, what are my options?

I know the deal is as is no warrantee, but their's got to be some law that even used car you can't sell without informing the buyer something is wrong.

Stop payment at this early juncture should work, but you should have called the dealer bynow to ask aboutthe smoking and see if he'll just take the car back. You didn't test drive the car before you paid for it?

He did test drive the car before he paid for it and was fine.

What happened before paying for the car the dealer stated they will get the state inspection done nearby, this morning when my father went to inform the dealer, the dealer called the shop and they're now saying that instead of doing the inspecation they did an oil change and that the excess oil could be causing the burning smell and smoke issue.

They're now offering a 30 day warranty on the car and saying that they won't take the car back and if he doesn't want to keep it to take it up in court.

If it's just the oil issue he wants to keep it, but i've never had such an issue after an oil change, excess oil or not.

I did not test drive the car until late at night because the car is not for me it's for him so he purchased it for himself.

I kind of get what they are saying, but your dad should probably get the car inspected today for problems (pay the $50 or so), and if anything comes up, cancel the check today. Otherwise, it may very well just be excess oil from a sloppy oil change - even a little spilled oil will make a lot of smoke.

It could also be the cleaner/detailer that the dealer put in the engine bay to make it look "new". It was probably cooking off from the engine heat. Theoretically, if that is the case, it should be gone in a day or two.
