The small claims court will require you to have given every opportunity for the trader to make good, but if all else fails, that's the system to use. just make sure that if you decide to use this system, you have exhausted all other possibilities. Small claims court is here.

Good luck.
I have just advised the very same thing to Energetic on MSN.

If a sensible dialogue cannot be open with the breaker then the small claims court would be my next port of call.

One thing I am unsure on is whether the small claims court can be used by non UK nationals and those who live outside of the UK ?

Breakers often don't read emails, so you need to ring them and explain the situation in a calm manner.

If they refuse to help then you can let them know you are going to complain to Ebay (just to scare them) and to trading standards.

Also mention that you have posted this on the S2000 owners club.

Above all, be calm and polite.

Let us know how you get on.

Hardline fella, thats really shit.

You could report it with trading standards and maybe put the shits up and frighten them abit by saying you have a good case etc.

Really pisses me off stuff like this as its an insult.

I know you have the address, but do you have the name of the owner of the company ?

I have been doing a little searching through companies house to try and get some info, but I only have basic access.

Dewsbury is in West Yorkshire

If you go the the dealer's web site it tells you where

IIRC our member Fletch lives in Ossett, not many miles from Dewsbury

PM?

An update!!

The guy who sold the engine conversion to me finally replied in my e-mail. Below is his reply

Hi
This is your 1st email i have recieved since i sent you the engine. What makes you say it has not done 7100 miles.
Can you please give me detials as i need to check this out for you aswell i will get back to insurance company aswell to confirm.
this was the mileage showing on the car.

also plz advise what you would like us to do and how we can keep you happy if what you are saying is correct.

So can you please advise what is a good setlement for me? Bare in mind that i have received the engine here in Greece so to send it back i don't know if he will pay the transportation costs along with my whole payment?

The whole deal (engine, diff and transmission) including shipping to Greece cost me around 2700 pounds.

What do you propose?

Thank you in advance
Chris

As per our discussion yesterday, I would be looking to get some money refunded to you as means of compensation.

Sending the whole engine and gearbox back would be very expensive.

How much are you happy paying for this engine, knowing that it has done at least 40,000 miles ?

Once you know this, you can work out how much to ask in compensation.

Still start high, ask them for a full refund and that they should pay the shipping back to UK for the engine.

Of course they will say no to this, but to get yourself a reasonable settlement, you need to start at a high position.
