It all depends on the damage.

If its the subframe it will be too expensive and difficult to fix.

Nice idea but I cant be arsed !

Apparently the cost of the hire car for 40 days doesnt matter and wont affect it being written off - she still hasnt accepted liability of it though - been in hospital, hope shes ok, lesson learned no doubt. Until she does, Im not signing my life away on a pricey hire car - which will be similar to the car I have lost.

It's highly unlikely you'll get a like-for-like replacement hire car. I had a friend who had a Ferrari 360 which was involved in a similar type of accident. His insurers gave him a Ford Focus as a replacement car whilst the 360 was being repaired. Like most policies, the small print did not specify that the replacement car would be the same as the insured one.
