Actually, you're right James. State employees don't have to take them. It really isn't a law either. It's brought about by insurance companies. Companies that institute a drug test before hire get a break on rates. Total BS IMO.

The issue in our case was that the guy was operating a fork lift truck in a closed environment with heavy pedestrian traffic so it was the effect it had on his abilities that was the concern.
