What he does outside work hours isn't our business, but I think it's only fair that we be able to investigate someone so as to determine whether they may be causing a risk to co-workers.

Agreed. We have something in our contracts that says something along the lines of "you shall not be in a state where drugs or alcohol affect the way in which you carry out our work."

I guess if someone had a reasonable suspicion that we were high or drunk, they would have reason to require us to have a drugs test. Otherwise, live and let live !!

We have a drug and alcohol policy that is similar. The only problem is that by law we can't check someone if we believe that they may be under the influence.

We had a case of this a couple of years ago where a girl, that we had only recently employed, was observed by others to be staggering and suffering from a loss of dexterity. When I approached her, she was looking through the first aid cupboard, she could barely stand. To cut a long story short I offered to have our foreman drive her home, she refused and decided to drive herself home. (she still could not stand un-assisted) We called the police out and they confirmed that she had a hit of cocaine however she was within her rights to legally drive herself home.

The worst part of this is that legally if she had an accident she could sue us for allowing her to drive home even though legally we can't stop her.

Peter, that is some very disturbing information. What kind of a law is that? I mean, who is that supposed to protect, really!?!
I don't see why your office could be held responsible if she was in an accident. It's not like you're a cocaine distributor. That's a bullshit law.
