Default Pulled over

I was pulled over today and the cops were D#$ks. They said that my invidia V3 exhaust didn't comply with Florida law. I told them that it was Carb exempt and 50-state legal, but they gave me attitude. I bought this exhaust used and was wondering if anyone here locally has a Invidia with the carb paperwork so that I could fight this BS in court. I am going to try and contact Invidia and see if they can send me anything as well. Any help would be greatly appreciated!

Are you sure it is exempt? It could be because of the noise. See the hard thing is every state statute is different.

I remember getting pulled over once for a HKS exhaust and the only paperwork I could find was the exhaust was legal to California statute. That means it was not covered in the statute. So I just waited for over a year and went to court hoping he wouldn't show because I would of lossed and he didnt show up.

I don't have any friends who has fought the cop and won unless they didnt show up. Your best bet is to see if you could get a lesser ticket if ask the judge to swap on your stock exhaust.

One of my friends told me he fought the ticket and the judge said that the police officer has the correct judgement to say if it is loud or not.

Hey I hope you can get this fixed but Im just trying to help because I've been in this situation and lots of my friends.

Did the officer have a noise meter with him? If so did you ask to see it's calibration status and his training to be able to use it properly. These are items you could fight if you decide to go to court on it.

even then, it is subjective at best. A stock enzo or murci or carrera GT or GT-40 is hella LOUD from the factory.

What about all those Hawgs we hear from 76 blocks away...... those are straight pipes and other mods done to those too.

This Exhaust ticketing garbage is just more revenue generation for the state IMHO. Fight it

sounds like I'm back in California lol... Cops have the right of way when loud exhaust comes in... Just save the trouble, put you stock one back on, then have it write off. Then after a week put the exhaust back on...

The thing is thou they will come up with the defense that you have modifed your exhaust to make it louder, so thats illegal. Exotic cars don't fall into this because the maker buys and pays for all the dues when introducing the car into the States. But, Honda has to obey the min. law for smog, exhaust tone, safty etc... They can't afford to spend hundreds of millions of dollars to pay off the US so that we can have 100db exhaust note...

Honda cant afford hundreds of millions of dollars but companies like Lamborghini and Ferarri can??

the burden of proof is on the officer at the time of the citation. if they had no measuring device how can they be sure there was a dB infraction. The cop cannot possibly determine if the modified exhaust is, in fact louder, than a stock S2000 unless he has the proper equipment to record the suspect vehicle and documented proof of a stock S's sound.

This case is easily beaten if it is presented in a clear consise manner. they have to prove that it is louder than stock, plain and simple. Just having an aftermarket exhaust on your car does not mean it is louder than stock.

I understand what you are saying but it is a deafest perspective.

I would fight it. I would fight it with a lawyer in tow, but I would fight it.

Was the ticket you got for just the loud exhaust? Or was there also a speeding/reckless driving/running a red light/ etc ticket given?

If it was *just* for the exhaust, I'd go to court as others have suggested--but if there are other violations/tickets given, I think I'd be more worried about those than having an loud exhaust.

might be different here in Florida, but in California they will give the cops the right to know what is loud and what is not... Stupid really if they have the so called db reader law and what not... They also revised a lot of the old laws this past January too, so look out for that too.

I agree if presented well it will get thrown out of cout because the cop was profiling you in the "racer" image...


how much is the ticket anyways? might as well just fix it and pay it, if you don't want the hassel of doing all this stuff... But i'd fight it too
