Pulled over
You can't use an excuse about other cars being loud. They weren't the ones getting tickets and they aren't the ones in court. Just because they have louder cars doesn't mean you have to be just as loud. Who knows maybe they have gotten tickets and choose not to change it. Thats the risk they take.
You can create a fake document until he calls your bluff or actually tries to contact who created that test. The judge then can be a real dick. Then you are lying under oath and what if you get caught. I would rather not take a $200 ticket and take a risk and end up being much more.
I understand you don't want to pay up for something that stupid but you did break the law. Didn't you? Can you handle the truth?!? hehe j/p

OK...here is my $.02: I think you could win a case if the statute cited was the 316.293(2). If it was 316.293(5), then I think it would be a tough case. Hopefully KeithD will chime in as a real attorney, but from my days where I had to analyze bills and new statutes for a living, I would say that (5) does not referrence (2) and (4) clearly gives enforcement the authority to ticket based on (5) regardless of (2). The test would be if the aftermarket exhaust at any rpm exceeds the oem db...and the Invidia clearly does...as do many of the aftermarket exhausts we choose to install.
Shawn...perhaps you are thinking of a different statute, but I would disagree that (5) makes any modification illegal. If that were the case, then every muffler shop in the state would be illegal, and any LEO would simply need to sit at a muffler shop and ticket every person who gets a Midas replacement and make their ticket quota for the month. The burden of proof is on the officer that the replacement exhaust is louder than oem...not a very difficult burden to meet where the Invidia is concerned.
So here is the deal...we all know we put these exhausts on and make other mods that are clearly illegal. The law maybe stupid, and we as citizens can push for a change in the law. But until then, look at any ticket you receive for your loud exhaust as a pay-to-play tax. For example...I speed...I break the law...I know I do it...and I know I face the risk of getting a ticket if I am caught. I generally don't fight speeding tickets simply because I know I do speed, so I look at the ticket as my speeding tax. And I'll probably do the same if I get a ticket for my single exhaust...I know that it is illegal, but I want it anyway.

Did the officer have a noise meter with him? If so did you ask to see it's calibration status and his training to be able to use it properly. These are items you could fight if you decide to go to court on it.
this is bullshit there are so many people out there that are doing harm on the streets and there pulling us over for exhaust violation or whatever like i said thay should stop pulling people over for some bullshit like this there is no more emission's coming out of the exhaust than stock unless you have a test pipe as far as i know anyway lets get over this contraversy and 03ap1 let us know how it goes.

Adding the "illegal exhaust" ticket is no different than getting a ticket for speeding, and then getting a ticket because you aren't wearing a seatbelt, or you didn't have your kid in a safety seat, or you don't have current insurance etc.
[quote name='dangators05' date='Mar 13 2007, 06:54 PM'] Let's all take a deep breath for one minute and think about the following...
Does it really take an expert to know that the Invidia V3 is louder than stock?
Stock exhausts (other than exotics) are generally pretty mild, can the same be said for the V3? Seriously.
Primo: You make it sound like the OP has a constitutional right to make his exhaust louder than all hell. In fact, the statute seemed quite clear to me. There is no requirement that Officer Joe use any specific instrumentation to measure the Db levels. It says that the "measurement procedures MAY include..." and says nothing about what procedures MUST be taken. So when the OP's exhaust sounded louder than hell, he was written a $75 ticket.
