Ugh!!! Sorry to see that

submit it to your insurance company. This is a 'no-fault' state anyway so regardless of actual fault your insurance company has a duty and much better resources to handle this type of thing.

Subrogration is a standard within the industry and requires less action on your part.

Shouldve filed with her insurance. If she admits that it is her fault, then you would have an easy case.

That damage can't be more than $750, so i dont recommend making a claim.

And as far as diminish value, you're not gonna get any unless its over $2000 of damage or something of that sort. And even then, it is not even worth it since the appraisal is anywhere from $300-500.

Good luck and always grab an eye witness when you're involved in an accident.

I have Allstate, and more than a year ago my 18 year old son (in his Honda Civic) rear ended another car, his fault and he was cited. I dealt with the adjuster and they suggested I use one of the shops on their list and the work is guaranteed by Allstate, however I could use any shop I wanted.

I chose to use a Honda dealer in Lakeland that was recommended by a friend and Allstate said fine. I (my son) paid the deductible and Allstate took care of the rest (6k), no questions. Also the dealer gave me a choice to use orig. Honda parts or aftermarket knock offs and we chose orig. Honda parts and the adjuster was in the loop the entire way, no complaints or objections.

My son had an issue with a power window regulator about 8 months later and I called the dealer where the work was done and even though the warranty was expired they said the regulator was replaced during the repair and they took care of it even out of warranty.

BTW, even though the accident was my son's fault our insurance did not increase. They have "accident forgiveness" for the first accident.

My advice: Get it fixed the way that you want and that makes you feel comfortable by someone you trust.

holly crap! sorry to hear about it, but im so suprized it's just the fendeR!! you're pretty lucky.

and +1 for nice looking calipers.

You may want to make a claim if you bring it to the bodyshop that I recommended, Brennan's. They have earned my trust. They are not cheap. My dime size divot cost $1100. I had a $500 deductible so it didn't matter how much they charged. About $100 of that charge was to flawlessly correct a slight dent in my door, a dentless, paintless repair. The repair charge to my rear fender was to repair the area surrounding and including the divot. Then, color matching perfectly the affected area. Clear-coating the rear fender. Removing the rear of the convertible top so that they could remove the rubber molding to clear-coat under the molding, not just meeting the molding. (This process was done by a convertible top company that they trusted).

I am sure that there are alot of great bodyshops out there. I just wanted to share my experience.

Yeah, the calipers do look sweet! All that hard work and sweat payed off. Though I have to give kudos to my personal pit crew! They did a great job taking the tires off and putting them back on.

As to my car, I am definitely going to get it fixed to my satisfaction. There is no doubt about that. I'll see what the adjuster says estimate wise tomorrow and interview the Allstate body shop as well. From there I'll call around other places that come highly recommended, such as Brennan's, and get their estimates.

The other driver isn't admitting fault b/c her insurance is still undergoing an "investigation." So I am waiting on the response. If they won't pay then I am going to call them directly with my lawyer, aka Dad.

I know Allstate will work with me if I do have to continue with the claim b/c they did with my hubby when his SSR was keyed. Also I shouldn't have to use my accident forgiveness b/c the claim is filed as "Not at Fault" so I should be good. So thanks!

And Bandiscoot, I guess my car wants to be your like yours.

please don't follow anything i do with my car ... most time it ends up at the body shop.

good luck with finding a great shop ... that can be the greater frustration with a situation like this.

Sorry I am jumping in so late here but I have a couple questions:

Did you do a complete driver information exchange? (ie do you have her DL #, ins info, etc)

Did the responding officer give either of you any type of paperwork?


I had a similar incident years ago in a Publix parking lot. A girl backed into me after I had already backed out of my spot. We didn't call the police because it was a private lot and neither car appeared damaged (her bumper impacted my right-rear wheel/tire). Fortunately, we did exchange info. and as soon as I drove off I knew something was wrong with my car as the alignment was WAY off. Long story short I had some pretty decent suspension damage to the tune of $800.

I went to a police substation and got an "After the Fact" accident report. It is essentially an accident report that you fill out (including diagrams of what happened) and then submit to the police. I submitted copies to the woman's insurance company and they paid the whole thing no questions asked.

So, I would stop by a police station and inquire about one of these. Just because she didn't get a ticket doesn't mean she wasn't at fault. I know you said you already filed with your insurance co. but perhaps they could use this to go after her insurance. I really would hate to see you get popped by your Ins. because of this.

I have an accident report. I went into the Publix and called for police immediately. It was basically a driver exchange of information though since the cop said he was unable to cite her a ticket due to it being on private property.

I met the adjuster on Saturday morning at the Allstate owned body shop, Sterling. The shop was huge and luckily, my adjuster was very familar with Brennan's Body Shop that has been recommended to me to use. The adjuster was actually really cool and knowing Dave (I think was the name) at the Brennan's shop, my adjuster listed items and work to be done that he knew Brennan's would call him on. I even had him include the rim that was scuffed up. tee hee

So he estimated total cost of repairs at $942 and change plus my $250.00 deductible (total of $1192 and change). My adjuster went ahead and sent a copy of the estimate to Dave at Brennan's and he cut me a check immediately payable to myself and the shop. Naturally I also have a copy of the estimate. It included a new fender, blending of paint and all precautionary measures to protect door and surrounding areas from paint, alignment, and rim repaired.

Now if I could only hear something from the other driver's insurance company in regards to their "investigation."
