HisforHonda,

There are several local TV stations that would love to get involved with a story like this. If it turns out that you do not have a legal case against them you can always try using one of the local stations to influence the dealers decision to reimburse your money. Once it is all settled you should then tell them how you found out the car had been totaled. I would love to see the look on their face when they find out that the original owner identified the vin number.

please keep everyone on here updated on the current situation. dont forget about the BBB also. if it doesnt turn out to your satisfaction
then report the dealership to them.

Can someone recommend a Lawyer in the Atlanta area? I talked to my Lawyer, and he said I do have a case, but I need someone in Atlanta, since that is where the transaction took place. Thanks!

I am going to snap some pictures of the underside of the car, for you all to see. It is a mess down there. Thanks again for all your support and help. My stomach hit my ankles when I found out I had been taken. But talking to all you great guys on here, has made this process a little bit easier. Thanks again!

Good Lord man... that is an awful story. I was almost worried that you got MY car since I flipped it and it was declared a total loss. Looks like my VIN# wasn't that far off from 850's. I hope you screw that guy something ROYAL dude.

First... carfax doesn't always show whether a car has been fixed or damage! I would not rely on it, but it is a good starting point!

HisforHonda sounds like you have a problem. First legal rule "READ THE CONTRACT"!!!! What does it say? Does it say a "new or used car"? What about the warranty.... std factory warranty or limited warranty or "AS IS?" It MAY not matter what the dealer said orally... you need to look at the paperwork, that will be the controlling factor! How much did you pay for the car? All of these things need to be considered.

You purchased the car at AMG Auto Sales in Buford Georgia - NOT a HONDA dealer, thus the car is used. Do you still have the window sticker that was on the car? Most used car dealerships have a warranty sticker on the car... usually there you can tell what type of warranty you received with the car.

If you fax over the contract and warranty stuff I will review it.

Hey guys,
Information that is obtained Orally is just a binding as that, that is written, Just much harder to prove.

I suggest that you take a lie detector test, indicating that you heard him say repeatley that the car was not wrecked. Present this to the seller as evidence that will be presented in court. This may or may not ( probably not) have any impact in court, but it might be enough to get him to settle outside of court.

I am sure that the newspapers will pay for, and setup the polygraph test, just to add a new twist to the story.

It is worth a shot, specially if you get someone else to pay the $50 bucks for the test!

OMG!!!!!!! 850's old car???? I can't believe this happened and the car was fixed....and resold????

I hope this comes out well, and to think I almost bought a used 1994 Mercedez Benz SL500 from the same place........................glad I know this.......
