Ok, yesterday I pulled a carfax report, and it DOES show that at one time it had a salvage title.

I don't know if it makes a difference or not, but I had two friends with me when we picked up the car, and they ALL remember him saying it had never been wrecked.

Also, I work at a telecommunications firm, and have a record feature on my phone. What if I asked him again if the car has ever been wrecked ( using a convincing story of course ) and recorded him telling me no again? Will any of these things work? Also, I did sign a "sold as is" form, but that was under the premise that the car had extremely low miles and the factory warranty should have been in affect. Isn't he violating
"full disclosure" or something of that nature? I would never have bought a high performance vehicle with the extent of damages to the car. You should see what the underside of the car looks like! If I had taken this car to the track, and took corners at high speed, wouldn't my life had been in danger? Just looking for opinions here.

Opinion #1 - Get a lawyer involved. Sometimes just a letter from an attorney to the dealership is enough to make them take the car back.

Opinion #2 - Don't track a car that has been totaled. This car may be fine for day-to-day runs to the grocery store but that's about all.

Opinion #3 - Legally, I think you would have to tell the salesman that the conversation is being recorded.

Opinion #4 - Never buy a used vehicle without knowing the history of that vehicle (I know that it's too late now, but still).

As for the Salvage Title, most times a buyer does not see any titles if there is a loan involved. Usually the title would be sent to the lien holder. I can see how a shady place could sneak this by.

Lastly, please take some pictures of the repair! Your killing us over here, we want to see how bad the reconstruction work is...

Call the state title dept at 404-362-6500, they should be able to help you get a "title search" and copies of all titles issued in GA. If they won't help pm me and I'll give you my fax#. Send me a copy with your address and I'll walk it thru the state offce in Atlanta.
Like I said in my earlier post, what they did is slimey and gives a bad name to rebuilders.

*P.S. have your dealer check with Honda, I'll bet that the remainder of your factory warranty has been cancled. When a car is totled the manufactorer usualy cancles the warranty.

Looking for one now. My St. Louis Lawyer seems to think I have a case. But JoeyO knows the laws in GA better, and seems to feel it would be a difficult case to win. I wonder if I should fall back on getting the media involved and trying to settle out of court. I am wrestling with this decision. Maybe just a letter from a Lawyer threatening action would encourage this slimeball? I saw his house, easily in the 3-5 million plus category, so he can afford all the legal advice he wants, and may just laugh at any attempt to threaten action. However, a nice big video camera broadcasting to millions of viewers may change his tune. Anyone else see it this way?

Yea, I would never think of tracking it. I'm just saying that IF I had put it on the track before I knew of the damage to the car, I could have been in some serious crap.

In the state of Missouri you do not. As long as ONE party is aware of the conversation being recorded, it is legal. Anyone aware of what the laws are in GA?

I would try to settle matter out of court,
If things to work out, then inform him that you know that you have been taken,
and that you realize that you have little legal recourse.
But, since your story is true, and you want to others to learn form your mistake,
that you are going to sell your story to the media, to try to recover some of your lost
interest.

You do not need to tell him that you are recording anything, in the state of Georgia. We have same law you do. My wife had to apply for a permit for our company to record customer service calls. This is why you hear the "This call may be recorded for quality purposes."

Second avenue to consider.
If the repairs are as shotty as you have indicated, I would take it to a repair shop for a closer inspection. There must be some liability of the State's behalf if the car turns out to be unstable. If it turns out to be stable, then you may have the piece of mind, that the car is not going to cause an accident down the road.

About writting a letter to the dealer... well I'm 50/50. Sometimes it works other times it doesn't. In my opinion the law is not on your side, so I would be reluctent to write a letter for you. I do not like to lose!

Did you tried talking to a manager/owner of the dealership. Give them a call, you have nothing to lose, plus you can get a feel for them and then make your next choice. I would record this conversation. Yes, you can record your OWN conversation, without informing the other side of the recorder.

If they don't want to help you getting the media involved is usually a good option... Clark Howard to the rescue!

Too bad it wasn't 850 telling the story of how he saw is totalled car on a used car lot. We could have all been warning people about that one.

I've never heard of AMG auto sales! Must be a small used car dealer? I hate all Atlanta dealers anyway! All the salespeople are crooks! (That is why I bought my S's from Ohio!) Yes! If I would have found out that car is on the lot, I would have notify the whole auto community of the Atlanta area! This is what our local S2000 club is all about!
