So, legally speaking, he should have killed the guy?

Not that I'd feel sorry for the theif. I believe in personal responsibility. If you do the crime, then be prepared for all the possible consequences.

i would be afraid of the theif's revenge. if he is smart he will hunt down and kill the entire gang of thieves and their families before they get revenge on his family.

This topic is interesting....here are my two cents:

1.) The thief got what he deserved. If you by your own free will try and steal someone elses property, or threaten the life of others, all bets are off. Expect to get your butt kicked if you break into a house and the home owner catches you. IF you survive....big 'IF' there....instead of suing, feel blessed that you did not get your head blown off!!

2.) I am pretty laid back about almost everything....but I can guarantee you that if my property, family, or friends had their security compromised by some thief or scumbag, I would do just what this guy did. Snap and whoop the thiefs a$$ right then and there. Period. Before I even read the thread I was thinking, 'Man...I would grab a tire iron and finish that situation right then and there,' and laughed when I found out that is what the guy did.

3.) Sadly, in the U.S.A. the criminal has MORE rights than the property owner/victim many times. I have never really understood this, and always kind of thought it was backwards.

4.) Did I mention that I agree with what this guy did?


(*Side note: I do not condone very much violence. But I have to say that when criminals get caught and have 'street justice' taken out on them, they get what they deserve. I love my family and friends, and I work hard for the items I have. For some lazy sh*tbrick to try and take any of them from me is a direct violation of a safety that I treasure, and they better be ready to deal with what they get when I catch them.)

Just this week in New Orleans, a guy got a suspended 5 year jail sentence for shooting and kill ing one of two theives who were trying to steal his car. This guy shot from the second floor balcony of his apartment and stuck to his claim that it was self defense. That is too excessive of force. He could be prosecuted for such action. A blow to the face with an iron bar is 1st degree assault, at the very least, when self-defense is not the case.

Most state laws state that only in cases of self-defense then "excessive force" can be used. Otherwise, let the law enforcement take care of it. This is clearly a case of extreme rage resulted in excessive assault with a deadly weapon.

Edit: just re-read the "concealed weapon" part. Well, that eases the whole situation, but still it was excessive force because he was not in a position of danger. Under the law, he should've let the authorities handle the situation if his safety was not in question.

OK, I have to jump into the minority here...

By admission in the original story, the thief was unconscious during most of the beating.

This was not self defense, this was REVENGE!

"i did it not only for myself, i did it for all those who have had their cars or personal belongings stolen and or vandalized"

This thief was clearly a criminal and hats off to a brave citizen who helps get one of these scumbags off the street, but we're supposed to be a civilized country of law here! Our laws are based on justice, not vengeance! Is it fair for a jerk to be maimed and have possible brain damage because he's stupid enough to try to steal a car? If the idiot had pulled the gun, this would be very different, but he was knocked out and as such no longer posed any threat. I do know about adrenaline, and I wish this poor young victim (not the thief) the best in civil court. I also hope for both their sake that the damage is not permanent. Brain damage won

When I was 18 I had a gorgeous little mini truck. Lowered, killer stereo, converted into a targa top. Bright Red. Man I loved that truck. One morning I went to go to school and found the roof sitting on my lawn and thieves had tried to steal my stereo system. They didn't get much cause the equipment was mounted well. However, the sense of violation I felt that day was unreal. I felt like I had been raped. With all due respect to those of you who believe we are a "civilized" society I say this: Anyone who breaks into my car better hope I don't catch them and have a tire iron, or some other blunt instrument, handy. I won't knowingly be violated that way again. It's ironic. Our "civilized" society was a lot more peaceful when people had to worry about what would happen to them if they were caught doing bad things. And when I say worry about being caught I don't mean by the cops but by those they were wronging.
