Default Speeding Ticket Which Seems Unreasonable

Was heading down college and I got pulled over for going 56 in a 45. I knew I was only going 50-51 because I was staring at my speedometer the whole time. Since the car still has temporary tags, I could only provide him with my temporary registration and license. He didn't sign my copy of the citation, I only signed his copy.

This is my second ticket I've gotten, the first one was for not putting on my turn signal (ridiculous) and it got dismissed a couple weeks ago (got the citation in like April or May). Should I fight the ticket so I get no points? Does having a previous ticket affect the outcome even though it was dismissed? Would it be worth it to go to the same people I hired before (ticket clinic), and does him not signing my citation provide more fuel to the fire for my case.

I don't know how it works in FL, but in GA I believe you have to be doing 15 over to get a point on your license. I got a ticket that was lowered to 14 over the limit and there was never a point. The officer told me that 14 and under is just a fine.

Just fight it. Schedule a trial date. While some folks resent my attitude about it and say court is for legitimate arguements against an alleged charge when you were ticketed wrongfully, I say use the system to your advantage as much as you can.

I got a ticket a couple months ago for "failing to stop at a stop sign." The intersection is misaligned and a 4-way stop. It's very difficult to see what's coming from any directions when you stop at the sign, so after making a full stop, I crept forward and looked around. The police officer was hiding around a corner and only saw my creeping and assumed I hadn't stopped at the sign located 15 feet back from the intersection itself (although I had).

Last week I scheduled a court date (government set it for May of 2010) and moments ago I opened a letter saying the ticket has been withdrawn. Why? Could be they determined that date was too far in the future, perhaps there was question whether the cops were ticketing appropriately, I dunno.

I'd like to think they saw my name on the ticket and had heard I could be a fierce legal competitor.

Knock on wood, my record for receiving and contesting tickets successfully is 4/4 in the past 3 years. Only 1 of the tickets was deserved anyway.

FIGHT IT!

Oh I forgot to mention that it was an unmarked SUV that was pacing me apparently. Not sure if that helps any.

start using your turn signal and stop speeding? oh and look at the road instead of staring at your speedometer

i don't think 11 over will affect your license (points), it's your insurance that may be affected. if the first ticket got dismissed, then no, it's not on your record either.

i'm mildly kidding with my first comment, but you have to remember, we get this same "i got a ticket for speeding, what should i do?" topic in here basically every day

I think s2ki needs its own Legal Advice forum, and a speeding ticket sub-forum within. Theres atleast one of these every week.

That said, I dont really see what argument you have against the ticket.

I agree here, fight every ticket every time!!! It costs them ALOT more to bring the cop in to contest you, and thats also 1 less cop to be writing tickets for those few hours you are there. It costs them MUCH more to convict you ticket in court if you contest as opposed to just paying up and shutting up. FIGHT!!!

if he was pacing you you have a great chance to beat it.

even if he shows up to court, if you have a valid arguement and you sound intelligent, you have a good chance to beat it.

do some research. ask him how he measured your mph speed, how accurate that is, etc etc...



alot of depts (esp in CA) are giving out BS tickets casue the state needs money. Just paying them is ridiculous.

I recently got a "40 in a 25" bs ticket and it was dropped. she was "pacing" me.
