No the Constitution is a GUIDELINE, that is why there are amendments! To fit the needs of the people of the time. Anyway, WE ARE WAY OFF TOPIC!

You either can't understand the case or you are trying to mislead on purpose. Or both. Read the opinion. All of it. The opinion finds that the FCC did not violate the First Amendment.
Of course the holding is narrow. It's a First Amendment case! They're all bloody narrow.
It comes down to this: we're going to have to agree to disagree. Not a bad solution as the Court itself has problems on this issue.
Edit: And no hard feelings, I would hope. All in good fun. Rage on! Viva Cohen! (My favorite 1st Amend case incidently...even went to a Halloween party dressed as Cohen. Look up Cohen vs. California--you should like it.)
