100% the truckers fault. I dont think there is any other way to see it. The car was on the shoulder, the truck was not in his lane. The cop had to have its lights on to facilitate the other car to pull over. Looks like the trucker fell asleep or something caused him to drive onto the shoulder. Even in that was the case, you are still responsible to maintain control of your vehicle. Trucker is getting manslaughter in the very least.
