Default Is it done or what?

Well I was on my way visiting some family about 2 hours away from home. Sitting in my car at a red light in farm country drinking some Rockstar.... and BAM..... some guy from texas who was lost looking at his map rear ended me

You guys think it's totaled? His insurance State Farm is being a pain. It's been 5 days now and the car is still at the junk yard. They haven't even sent out a adjuster yet but instead calls the wrecking yard and ask if it's totaled or not. The old dude says it might be ok And says that they can take it to a local shop to get it fix. I told him to get a adjuster out there and if anything I want the car towed back to my place 2 hours away to get fix. State Farm says they can't do that and ask if I can call my insurance and see if they will. In return they will pay for the deductable? Any advice? I think the car is totaled and my back is still killing me... Should I get a attorney?

This is making me sad, the Vortech with the 12psi pulley, EMS and my injectors are just sitting here. Good thing I swap out my Work S1 last week, check out the Rota's they splitted in half. If the car is totaled I will have all my parts for sale here some pics

By the way the car is a 2000 with 43,000 miles.

Id guess that it might be totalled and I would get an attorney. Especially if you are hurt and their insurance is dicking you around like they are.

Whoa He must have hit you REALLY damn hard. Doesn't look good. I hope your back feels better though and good luck with the insurance.

goto the hospital, get an attorney. glad to see you are ok. what kind of car was he driving btw?

He was in a chevy avalanche going about 45 I believe. I was at a complete stop.

Haven't heard from State Farm yet, going to see a doctor for my back today. And than a lawyer tomorrow if they keep messing around.

sorry to hear about your accident and hope your back is ok. screw waiting around; get in touch with your insurance, they will go after the other guy's insurance for you.

Its a total loss fo sho man. Forget the lawyer, just save all your medical records from your visit and submit them yourself. That is all the attorney will do and take 20% of what you get. Unless your too busy to handle it yourself of course..

Most attorney's wont get involved in the property damage.

If it is in a rural area that may be why it is taking so long for them to inspect the car. They may only have on adjuster in the area or have to hire an independent.

State Farm usually pays by NADA and they are pretty fair when it comes to adding on for aftermarket parts. Just do your research.
