If a dealer ever tried pulling something like that on my car he would be getting a screwdriver between the ribs.

Maybe a good lawyer could convince a jury it's just a wear spot.
I enjoyed that

Heres a few pics I just snapped. Lucky for me its raining outside, go figure. Its small but def a rip not a wear hole. Sorry there not that great but the shot from the top looks like a damn flat head screwdriver puncture if you ask me.

I once managed to poke a hole in the top of one of my MGB's with a common screwdriver (you guys in the peanut gallery can stop laughing anytime you like ) and that's not what the hole looked like. It takes a pretty hard jab for the screwdriver to penetrate the material, so the screwdriver won't stop with just the tip sticking through; Rather it will end up going well and thoroughly through the top and sticking out an inch or more on the other side. Because of the shape of a common screwdriver tip this makes a hole that is much wider than shown in your picture. I can't be positive, but it looks like it was a sharp object or something that didn't taper like a screwdriver. It doesn't look like wear, because that's just not what wear looks like.

i think you're SOL because of the age of the car and top. no matter whose fault it is, convertible tops really only last 3 years. i would never take the side of the dealer, because i have had terrible experiences with dealers, you feel so helpless and out of control when someone you don't even like is telling you bs. but the bottom line is, it is out of warranty and will be very hard to prove they damaged it to a third party. you really have to figure the hassle index here. me? i got holes all over my top, and all because of defects in the top/mechanics. but there's no way to prove squat, i thought the top was damaged by someone and was not a defect. the day i bought the car was the day the warranty expired.....if worse comes to worse, file a police report saying the car was damaged (it was), then do an insurance claim. it'll save you 1100 dollars at least.....

Yeah, definitely not true. I have had the same top on since 2000 with no wear holes whatsoever. Granted, my S2k only has 20,000 miles on it. Unfortunately, a thief decided to slit my entire top...

WHAT? The top on my MY00 S2000 is now almost seven years old and is holding up just fine. We had to replace the top on our MX5 last year (after 16 years of use) because a tree limb came down and punched a hole in it. Anyone who goes through convertable tops is three years has to be doing something wrong. That's like going through a clutch in 12,000 miles. People do it, but there is no excuse for it.

Same here, only my car is two years older. Right now my plastic rear window is due for a cleanup, but once I polish it up the top will look like new.

Three years is just nuts.
