Tim Please Refund My Money
I can vouch for Tim also... my AEM V2 intake was bent and crushed and I know it wasn't shipped that way because I ship things around the world and I take digital 5MP stills of each item I send out. I've had the worst experiences with both FEDEX and UPS, but surprisingly very minor problems with USPS. Tim is a responsible seller.
I can't help but feel sorry for Tim as he's taking a huge hit here (I took a $4200 dollar hit when FEDEX dropped shipped 2 laptops to my friend with no signature when the shipping terms was signature only and when the case eventually made it to court, I lost but still contesting the ruling with a different law firm.)

I'm not making any judgements or recommendations at all on this issue (so please don't shoot the messenger
) but from a legal perspective...
If the UPS driver failed to acquire a signature for the delivery then UPS (not the vendor) is liable for the goods as they would be deemed to have failed to fulfill their service agreement. This is the whole purpose of obtaining a signature. It is this 'proof of delivery' part of their service that is designed specifically to avoid situations like that described above and that is one reason people pay a high price for trackable express shipping. If UPS didn't obtain a signature then the vendor is not liable, they are.
It is the buyer's responsibility to take out or request shipping insurance when placing an order although UPS (and most other major shipping companies) will automatically cover up to a certain amount by default though this is often not enough to cover the value of the goods lost.
Simply charging back can result in a customer ending up on the wrong end of a fraud charge if the vendor can provide the necessary documentation to prove the order was filled and shipped so when somebody recommends this 'solution' think very carefully about it.
I for one do not believe that shipments simply go missing or get 'lost in the system'. They are either dumped or stolen.

Ive had lots of packages come ups.. When i tracked the number.. it would say delivered to my house.. and all they do is just drop it off somewhere around the house.. the longest ive gone without finding the package is 3 weeks.. turned out. ups actually delivered it to my next door neighboor.. and they just forgot to bring it over.. ups has done that more than once to me.. but when you call or track it.. it says it was delivered to your house.
Always ship "insured."

I purchased an $850 radio receiver shortly after 9/11 from a fellow ham in New York. This was during all the anthrax/postal mess. I sent a bank money order and he never got it. The fellow's name was common, similar to John Black. He never got the money order so I went to the bank and learned that if the money order was stolen, signed (forged) and cashed, I was SOL. There is no "stop payment" option on a money order. I was lucky. The money order never turned up and I got a refund.

I purchased some great Muz trunk liner mats on a group buy on this board. FedEx lost the package. The item was only insured for 70% of its value. I got back the 70% and was out the 30%.

I ordered my GREAT JDM Honda BBS 16" forged wheels with lug nuts and center caps in January. This was part of a group buy. I was promised March delivery. The shipper bumped my delivery to April claiming I wasn't part of the first six but I was part of the second six buyers. (I was part of the first six but I think I got bumped because the seller got an order for two sets.) In late May I got the four wheels (perfect condition) but no center caps or lug nuts. The seller claimed that the first six got shipped from Japan with the center caps and lug nuts but the second six sets didn't. Was this my problem? No! I whined and whined and whined and eventually the seller bought the lug nuts and center caps in the U.S. and sent them to me ($250 value.) I would never do business with that seller again. They've left the board. I saved a ton of money buying the wheels this way, and I had to put up with extra frustration.
Always ship insured for the value. Never pay by money order. Expect extra frustration with on line business other than from the giants like Amazon or the class acts like Rick's.
Buyers, ALWAYS SPECIFY YOU WANT THE ITEMS SHIPPED INSURED.

UPS is ass they drove a fork lift through 2 boxes that contained a set of rims for my old car. Then they bitched to the store i got them at saying that the store did it even though the store didnt even own a fork lift or even need one to lift some 20 pound rims.
Sometimes I find that insured is a pain in the butt but worth it in the long run if a customer has a dispute ... I have a insurance option on all my ebay orders ... when a package is damaged or lost they simply get a full refund of what they paid if they had bought the insurance ... I get several from ebay (why i have 3 negative out of 1400 or so) that do not bother with the insurance option and something is damaged or lost ... it was their call to begin with ...

FedEx takes forever to send out a check, as for the claims they require the following

3. receipt of item shipped
4. full retail proof on item
5. If you insure for more than what the item is worth you only get what the item is worth
Dont waste cash on insurance valued more than retail on items for more

Now if we can take care of s2ksoon with the missing hardtop parts
that should be taken care of today as well
