I don't recall seeing anywhere in the manual that you have to check your oil filter for tightness or leaks every time you fill up?

Only to replace it every 3250/7500 miles depending on your conditions. You seem to be well within that range.

If they deny claim, and your insurance says they will not deal with it either they might decide to go after the dealer themselves, and pay right now to have your car fixed), I suggest giving your lawyer a call again, get him to write a letter or two. (Nothing like having a lawyer behind you to get them to start working on it really quickly!!! ) Oh, and I'm sure a written statement from the dealer that currently has the car will not hurt either.

I brought my car to Honda for it's 1st oil change & was told the oil cap was missing. After further investigation, they found it on top of the tranny & it took them a half hour to retrieve it. I had oil sprayed around the engine compartment but no damage. It looks like it vibrated free.

The only way Honda will pay for the repair is if they can prove that it was a mechanical failure of a part. If it happened to be the technicians fault who installed filter (too loose or whatever) it is up to the dealer to rectify. It should not be a problem to get taken care of either way unless honda suspects that the owner "fiddled" with the filter. Honda as a company and the dealership generally want to satisfy your needs especially since this repair and tow will probably not total over 150 dollars it will be fixed quickly and it will be free.
on a side note, I have noticed that my filter and drain plug will loosen over time, it may have to do with the vibration the engine produces. I check my filter, plug and filler every couple of weeks after hearing all of the problems and having my plug loosen twice.
It would be cool getting a new engine at Hondas wxpence but I would rather not ave to deal with the inconveinience.

Has any considered what would happen if the oil filler cap may not have been tightened all the way, and it evenually worked it's way entirely off, thus spraying the passenger side at 85mph?

Opss... quess I skipped over the findings due to reading the thread too fast.

This is the second time today that I've been amazed (in a bad way) by a Honda customer service story. So Honda has denied any responsibility and sent you to go after the dealer on your own? Seems to me that any other car company would have taken care of this for you. They would have just told the dealership to fix it for you. Anyone else ever have this kind of problem with another car company?

I work for Probex (www.Probex.com). We re-refine used motor oil into new base oil. The "Flash Point" of used motor oil is greater than 350F. The "Auto-Ignition" temperature is between 500 and 800 F depending on the amount of volatile componds (contaminates) in the used oil. Fairly new motor oil will auto-ignite at the higher end of that range.

It should be noted that motor oil is considered "combustible" but not "flammable" (see NFPA for definitions). You can even use motor oil to put out a wood/paper fire.
