Wow.......

What are your driving habits like? Leave your foot on the clutch when cruising, partial engagements to hold yourself on a hill?

Even then....4k is way too soon. Had you noticed any slipping before total failure?

I dont ask this to profile you (but am wondering if the dealership did), but how old are you?

with what you have told us, unless there is more to the story as dead bird suggested, it sounds very odd. I'd fight it..

I've bought the car in Late January of 07 in San Jose, CA. I barely ever drive the car and when i do drive it, i baby it.

I myself is 19 years old but this isn't my first stick shift. and i do ride a motorcycle on a daily basis so i am familiar with clutch usage.

I an trying to fight it but all they say is that unless there was a defect that caused the clutch to burn out, the warranty won't cover it and my estimated payment would be $1990.00 + Tax.

I'm in the process of trying to contact the main customer relations of Honda to try to fight it

A bad driver can easily burn up a clutch in 4k miles...without ever driving the car hard. And sometimes defective parts cause a clutch to fail prematurely.

Not saying you're a bad driver, but then again maybe you are. We don't know. Your warranty clearly states that it covers "defects in materials or workmanship" and not incompetence.

was the car used as a Demo car on the lot? Maybe someone who took it out on a test drive roasted the clutch. You say you baby it so maybe you didn't notice the damaged clutch until 4k miles goes by and the clutch is gone....

Well, they haven't even dropped out the tranny to look yet, they are going to do that tomorrow but that is the estimate they gave me if it there isn't some kind of defect.

Well i doubt i'm that bad of a driver considering i also have a Integra DA with over 40k on the clutch and it still works fine, or my Bike that has 7k on it and it still works fine.

The car did have about 80 miles on it when i picked it up from the dealer. They said it was never test drove by the customer but it was actually driven there from another dealership by an employee.

When i bought the car, i had doubts of it becuase of the mileage it already had but my friends RX-8 that he bought with over 200 miles off the lot brought my confidence back up.

I'm going to see if i can contact corporate of Honda to dispute it, probably useless but i still want to try

Besides, this isn't the first thing that has gone wrong with the car, the O2 sensor went out when it was only at 12xx miles. I just didn't think much of it at that time because that was an easy fix

The warranty also stated clutches, brakes and tires are not covered under the warranty.

Unless clutch is covered in oil from a leak, the #1 cause of slipping clutch is the driver.

Even if the clutch was slipping, that would not cause the speedometer to read movement if the car wasn't moving. The speedometer sender reads the output side of the transmission. Something between the output shaft and the rear wheels not connecting would cause this, not a burned out clutch. Clutch being gone would make the speeometer read LESS than it should.

The guy at the dealership said that it was weird that the speedometer was registering a speed but his mechanic kept insisting that it was a burnt clutch

They will be dropping the tranny tomorrow to find the cause

I hope it really isn't the clutch so it will be covered under warranty
