Sorry for the huge long post:

What the dealer is trying to do sounds very dodgy. I would imagine that whoever had the car advertised and first agreed to sell it to you would be the person to go for. If they've offered to replace your car then they obviously know you are in the right. Send them a letter by recorded delivery stating everything you've told them over the phone, quote the sale of goods act and tell them exactly what you need them to do. Make sure you remind him that you will take him to the small claims court if he does not pay for repairs.
If he tries to claim you've treated the car badly remind him that as he sold it to you under 6 months ago then the burden of proof lies on him - so it is up to him to prove the car was in a satisfactory condition when sold and not on you tro prove it wasn't. He won't be able to do this.
As soon as the dealer got my first letter through the post (well second as the first went missing in the post even though it was sent recorded delivery) they were happy to sort the problems out for me.
PM me if you want a copy of the letter I sent to the dealer.
I didn't have the problem of not knowing who I needed to deal with though.
Make sure you report it to trading standards. If something dodgy is going on they will take it up. They once sent a letter to a kitchen company we were having no luck with, the kitchen was completed with a week.
(Edited to correct some of my spelling!)

It shouldn't matter about the issue of finance and so forth. Your contract of sale is with the garage where you bought the car. Basically even more reason to talk to Trading Standards if they're messing around.
You are perfectly right there, he sold the car to me n i put down a deposit n i got his receipt n now he is saying that the car was not his hehehe.
He explained the specs n demonstrated it to me.
He also told me he took in part xchange.

So he is liable.
Just emailed then, got a ref number and will call them tomorrow.

Thanks for the help. Much appreciated

Was it opposite a KFC fastfood place though?

As i remember looking to sell my yaris, and he offered me a small amount for it saying it still had finance left by the previous owner.

Obviously i knew it was BS as it didnt have any finance, and i paid outright for it privately.

I know a guy who used to work in motorworld and he said they are dodgy barstewards.
nah was like in a residential area, looks like there are many dodgy dealers ,well all of them are to be honest

There's no way that would stand up. You have to remember they're trying to make you give up. This is the main reason dealers sell waranties; not because people want them, but because when the shit hits the fan the dealer can direct you to the waranty company. The crappy Vectra I bought that failed after a week had a 3 month warranty, but I ignored the warranty company (who had clause after clause to get out of paying) and kept the pressure on the dealer until he did the work for free.

As LTB says, if you have legal cover on your car insurance that's a good place to start. The AA also give legal advice if you're a member (maybe the others do too).

I have to say I found trading standards a bit useless when I went through this. All they did was email a link to information on the web already.
Yes got legal cover on my insurance , going to call them tomorrow. Will keep u posted.

The funny thing about it was when i mentioned the word "court" to him/if i should say my car dealer, although it appears I have 3-4, he proposed to offer me a swap with a BMW Z4 56 plate but add more money or a direct swap for a BMW club sport.
He said that he didnt have to do this because he was not to blame for this (he is the main culprit here) so for kind of goodwill he offered me to come over to his a pick a car.
I also mentioned that i was left stranded no car-he offered to lend me a car until I swap for one.

Is that a sign of panic from him? hahaha

O also he kept on saying because I got along with him he was going to do this gesture but kept insisting he was not responsible, car was not his. And said he could just walk off n not help me at all.

There was a 2002 S2000 on Ebay a few months back, I remember it as it was same year and spec as mine (and yours) it was very cheap as it had "mechanical trouble" I have a search and see if I can find the Registration.

I hope you get this sorted Yan.

Seems to be me as if they have sold you a dodgy car to begin with sorry to state the obvious.

Did you notice anything odd or wrong with it?, you need to note this down and play a bit dumb that you dont know anything about cars and see what they say then record it, ring them up and record it.

Trading standards it might put some pressure on them, but the problem is as people have mentioned theres allsorts of get out clauses.

T**ts!

Good luck pal.

And remember note down EVERYTHING so you have good ammunition, with dates and times.

I remember having problem with an insurance company the call was recorded and i prompted them about something asking them to explicitly state some facts and they put themself in the shit as it was recorded.
