They can ticket you for failure to maintain control of your vehicle and for "defective" parts like bad tires without you even being involved in an accident, only running off the road qualifies.
For that matter, if you run off the road within city limits and damage city property like a flower or tree the city can sue you for damages! Trust me on this my friend was sued by the city for doing just this! he got a reckless driving ticket for spinning out into the median and tearing out a newly planted tree! lol. It was raining and he was driving a 300ZX with bald tires.

^^^ I was in court once. Hadn't stepped up to judge yet. Guy up there standing next to VA St Trooper explained that he'd lost control of his vehicle in the rain. Bad spot. Fellow explained to judge that while trooper was writing him up for a ticket (failure to maintain control), another car lost control and hydroplaned into median across from them. Guy asked judge for a break. Trooper retorted, "I wrote up that other driver as well"... From the general seating area a guy spoke up, "I'm here too, Your Honor"

I was coming off the onramp to 495 and it was still kinda damp after the millionth storms we've had lately, and my fwd civic starting rotating and I ended up doing a 360! Somehow, no cars were near me and I avoided the walls...whew.
